U.S. Senators Meet With Rosa Maria Paya

Senators Meet With Rosa Maria Payá, Discuss Democracy In Cuba
Senators Renew Call for Investigation into Death of Payá's Father, Oswaldo, A Political Reformer
Washington, D.C. – A bipartisan group of Senators met with Rosa Maria Payá, the daughter of Cuban political reformer Oswaldo Payá, in the U.S. Capitol today, to discuss democratic reforms in Cuba and to reiterate their call for an investigation into Mr. Payá’s troubling death last year in which he, and youth activist Harold Cepero, were killed in a suspicious car accident.
The meeting today was hosted by Assistant Majority Leader Dick Durbin (D-IL) and Senator Marco Rubio (R-FL) and was attended by Senate Foreign Relations Committee Chairman Robert Menendez (D-NJ) and Senator Bill Nelson (D-FL). Last month, the four Senators sent a letter to the Inter-American Commission on Human Rights, urging the Commission to investigate Mr. Payá’s death. A copy of the letter is available here.
“Oswaldo Payá’s death has meant other courageous Cuban democracy leaders must continue the work of fighting for their freedom and exposing the regime’s cruelty. It is our job to support these leaders that Oswaldo inspired and laid the groundwork for, while holding the regime accountable for his death,” said Rubio. “Despite her tragic loss, Rosa Maria Payá is a courageous woman who deserves the support of the United States and entire international community in getting real answers on Oswaldo’s death through an independent investigation.”
“Oswaldo Payá’s death was a tragic blow to the peaceful and courageous democracy movement in Cuba and deserves a full and open investigation,” Durbin said. “Rosa Maria’s tireless efforts to call attention to her father’s death show that efforts to reform the political climate in Cuba will not be easily silenced. We stand with Oswaldo, Rosa Maria, and the thousands of Cubans calling for peaceful reforms in their country.”
“Rosa Maria’s commitment to carry on her father’s work without fear is demonstrative of her ceaseless commitment and that of many in Cuba’s peaceful dissident community to demand political reform in Cuba. Unfortunately, oppression in Cuba in the last year has escalated with more violent attacks, detentions and arrests. The murder of Oswlado Paya is symbolic of the ends to which the regime will go to threaten and obstruct the growing chorus of voices calling for change in Cuba. I both honor and admire the work being carried on by Rosa Maria in honor of her father and was very pleased to welcome her to the Capitol today and hear her father’s story,” Menendez said.
“Oswaldo Payá will forever be remembered as one of Cuba’s best known dissidents,” Nelson said. “But the causes that he championed — freedom of speech, press and enterprise — continue to elude the Cuban people. That’s why a thorough independent investigation into his death is so critical. Without it, further reform is easily undermined or avoided, altogether.”
Oswaldo Payá was the founder of the Verela Project, a petition drive that peacefully sought greater political freedom for Cubans. The Cuban Constitution guaranteed the right to a national referendum on any proposal that achieved 10,000 or more signatures from Cuban citizens eligible to vote. In May 2002, the Varela Project delivered 11,020 valid signatures to the Cuban National Assembly calling for an end to four decades of one-party rule.
As a result of these efforts, Mr. Payá and his colleagues faced sustained harassment and as many as 25 of its leaders were jailed as part of massive round up of dissidents, known as the Black Spring. Payá’s nonviolent attempt to seek political change was celebrated around the world, earning him a number of awards including the European Union’s Sakharov Prize and a Nobel Peace Prize nomination from former Czech President Václav Havel.
Since his death, Rosa Maria Payá has traveled the world in an attempt to highlight her father’s death and the need for political reforms in Cuba. In March, Ms. Payá appeared before the United Nations Human Rights Council in Geneva, Switzerland, where she asked the international body to investigate her father’s death.

¿No interferir?

Obama Administration Joins Calls for Paya Probe
In The Hill:
Obama administration joins congressional call for probe into deaths of Cuban activists
The Obama administration supports the growing calls for an international probe into the deaths of two Cuban democracy activists last year, the State Department said Thursday.
The declaration follows growing pressure from Congress for an investigation into the death of Oswaldo Payá, who was killed along with fellow activist Harold Cepero in a July 22 car wreck. The driver, Spaniard Ángel Carromero, was charged with vehicular manslaughter before being released to Spain; he has since declared that he was forced off the road by a car with government license plates.
“The United States supports the calls for an international investigation with independent international observers into the circumstances leading to the deaths of Oswaldo Payá and Harold Cepero in Cuba,” State Department spokeswoman Victoria Nuland said Thursday. “The people of Cuba and the families of these two activists deserve a clear, credible accounting of the events that resulted in their tragic deaths. The United States will continue to advocate for the rights of all Cubans to speak out of defense of human rights and democracy.”
Eight senators from both sides of the aisle sent a letter to the Organization of American States last week urging such a probe.
“Oswaldo Payá was a brave man trying to peacefully advocate for greater political freedom for his fellow Cuban brothers and sisters,” the senators wrote in a letter to Emilio Álvarez Icaza, the executive secretary of the Inter-American Commission on Human Rights. “It increasingly looks like he paid for that effort with his life. His memory and his family deserve an honest and independent accounting of what happened.
“We urge you for your consideration and stand ready to work with you on this important matter.”
Separately, Sen. Bill Nelson (D-Fla.) wrote to U.N. Secretary-General Ban Ki-moon urging an investigation two weeks ago after meeting with activist Yoani Sánchez on Capitol Hill.

Who Will Stand Up for Oswaldo Payá?
![]() |
| cubanexilequarter |
By Jackson Diehl in The Washington Post:
Two weeks ago a brave young leader of Spain’s ruling Popular Party stepped forward to offer a sensational, firsthand account of how one of Cuba’s leading dissidents, Oswaldo Payá, was killed last summer. Ángel Carromero said a car that he was driving in which Payá was a passenger was rammed from behind by a vehicle bearing official Cuban license plates. He said he was then jailed in inhuman conditions, drugged and threatened by Cuban authorities with death if he did not tell a false story about what happened.
Naturally, Spanish journalists quickly approached Foreign Minister Jose Manuel Garcia-Margello, Mr. Carromero’s comrade in the Popular Party, to ask for his reaction. One might have expected an expression of shock at the revelation that the Castro regime might have deliberately killed one of the world’s best-known advocates of peaceful democratic change, a winner of the European Union’s Sakharov Prize, and then abused and framed a prominent Spanish citizen.
Nope: Garcia-Margello didn’t hesitate to throw the leader of his party’s youth wing under a bus. The foreign ministry, he primly told the reporters, “didn’t have evidence” of Carromero’s account. “The only evidence” it had, he added, was an agreement between the Cuban government and Spain allowing the repatriation of Carromero, which “recognized... the legitimacy of the verdict” of a Cuban court that found him guilty of negligent homicide.
In other words, the Spanish foreign minister was saying he thought the Cuban state security service was more credible than a 27-year-old leader of his own party who spoke out, at the risk of his career and his conditional release from prison, because, as he put it in an interview with The Post, “I could not live, being complicit through my silence.”
It’s worth considering why the Spanish government, like the Obama administration and Latin America’s democracies, ignored Carromero’s allegations. If legendary dissident Andrei Sakharov himself had died in a suspicious car accident in the Soviet Union, and a credible Western witness had then offered testimony like Carromero’s, it’s hard to imagine that Ronald Reagan and former Spanish prime minister Felipe Gonzalez would have remained silent.
But first let’s examine the supposed lack of evidence. Carromero, Payá, Cuban Harold Cepero and Swedish politician Jens Aron Modig were driving down a rural road in eastern Cuba last July 22 when the crash occurred. The two Cubans riding in the back seat died, while Carromero and Modig in the front survived.
Carromero says the car was followed from the moment it left Havana; as anyone familiar with Cuba and its secret police knows, that is routine for dissidents such as Payá. Here’s a question for the Spanish foreign ministry: Is it credible that a vehicle bearing dissidents and two Western politicians would not be followed on a road trip? Right. So where are the occupants of the two cars, one with official plates, described by Carromero?
The Cuban version says Carromero’s car struck a tree. But the photo authorities released shows a sedan clearly smashed from behind. Unless the Spaniard somehow accelerated backward into the tree, the picture belies the official story. Then there are the texts: Payá’s family say they have SMS messages that Carromero and Modig sent to friends in Europe soon after the crash, saying they had been hit from behind and run off the road. And there is Modig himself: The young Swede, who was also detained for a time in Cuba, told Swedish radio last week that he did send the reported texts, and that while he did not remember the accident, “I don’t have any doubts about what is now revealed.”
Finally there is this: The crash marked the second time Payá had been in an accident in two months. In Havana, a car he was driving was also struck by a suspicious vehicle, injuring him slightly. His family says he regularly received telephone calls with death threats.
Perhaps the Spanish foreign minister disrespects Carromero enough to conclude that he is lying in spite of all the indications that he is not. Or perhaps he feels compelled to bow to political considerations: the Spanish government’s cultivation of the Castro regime, its gratitude for the release to Spain of several score Cuban political prisoners, its hopes that four Spaniards in Cuban custody will, like Carromero, be freed. Other Western governments desperately want to believe that Raul Castro is a reformer who is slowly liberalizing Cuba.
All these calculations assume that the possibility that the regime deliberately targeted and killed Payá is ultimately unworthy of international attention; that impunity for such a crime is a regrettable necessity; or that the case says nothing about the Castros’ real intentions. Were they alive, Andrei Sakharov and Oswaldo Payá would surely disagree.

WP: Obama Should Push for Paya Probe
From The Washington Post's Editorial Board:
Obama administration should urge a probe of Oswaldo Payá death
NELSON MANDELA was locked up on Robben Island. Andrei Sakharov was exiled to Gorky. Vaclav Havel was thrown into a Prague jail cell. Aung San Suu Kyi was repeatedly placed under house arrest. All of these courageous, dissident voices were muffled at some time by authoritarian regimes, but in the end, they found their way back to freedom. Oswaldo Payá of Cuba never got that chance.
Mr. Payá, who pioneered the Varela Project, a petition drive in 2002 seeking the guarantee of political freedom in Cuba, was killed in a car wreck July 22, along with a youth activist, Harold Cepero. The driver of the vehicle, Ángel Carromero, a Spaniard, was convicted and imprisoned on charges of vehicular homicide; in December, he was released to Spain. He told us in an interview published on the opposite page last week that the car carrying Mr. Payá was rammed from behind by a vehicle with government license plates. His recollections suggest that Mr. Payá died not from reckless driving but from a purposeful attempt to silence him — forever.
On Wednesday, his daughter, Rosa Maria Payá, appeared before the U.N. Human Rights Council in Geneva. Speaking for the group U. N. Watch, Ms. Payá presented an appeal signed by 46 activists and political leaders from around the world, urging the United Nations to launch an international and independent investigation into Mr. Payá’s death. The signatories declared, “Mounting and credible allegations that the Cuban government may have been complicit in the murder of its most prominent critic, a leading figure in the human rights world, cannot go ignored by the international community.”
The Varela Project was summarily and arbitrarily crushed by Fidel Castro. Ms. Payá told the council that Cuban authorities imprisoned the majority of its leaders. She said that Yosvani Melcho Rodriguez, 30, has spent three years in prison as punishment for his mother being a member of the movement with Mr. Payá.
Ms. Payá was interrupted in Geneva by the Cuban representative, who accused her of being a “mercenary who has dared to come to this room.” His attempt to silence her drew support from China, Russia, Pakistan, Nicaragua and Belarus. The U.S. representative spoke up for her right to address the group. She was then allowed to finish.
After Mr. Payá’s death, the White House paid tribute to him, saying, “We continue to be inspired by Payá’s vision and dedication to a better future for Cuba, and believe that his example and moral leadership will endure.” When pro-democracy activists were arrested and beaten at his funeral, the White House again spoke up. But in the past week, since Mr. Carromero’s interview was published, the administration has not uttered a word. What if it had been Sakharov, Aung San Suu Kyi, Mandela or Havel who was run off the road? Would it have said nothing? At this critical juncture, with new information at hand, the United States ought not to be complicit in silence about who killed Oswaldo Payá.
UN must probe death of Cuban dissident Paya: petition
The United Nations should investigate the death of Cuban dissident Oswaldo Paya, his daughter said Tuesday, handing over a petition to the world body and claiming her father had been murdered by the Cuban regime.
"They say that my father died in a car accident, but we have confirmed ... that they were actually crashed into and run off the road by another vehicle," Rosa Maria Paya told reporters in Geneva.
She was in the Swiss city to address the UN Human Rights Council Tuesday and to hand over an open letter and petition addressed to UN chief Ban Ki-moon and his human rights chief Navi Pillay demanding "an international and independent investigation" into Paya's death.
"Mounting and credible allegations that the Cuban government may have been complicit in the murder of its most prominent critic... cannot go ignored by the international community," read the petition, signed by 46 politicians, members of parliament and human rights activists from around the world.
Among the signatories are the former Presidents of El Salvador Armando Calderon Sol, of Uruguay Luis Alberto Lacalle and of Peru Alejandro Toledo.

Appeal for International Inquiry into the Death of Oswaldo Paya
An open letter to United Nations Secretary-General Ban Ki-moon, High Commissioner for Human Rights Navi Pillay, and Ambassadors of all Member States
12 March 2013
Excellencies,
We urge you to support our demand for an international and independent investigation into the alleged murder of Cuban dissident Oswaldo Payá, a world-renowned figure and recipient of the European Parliament’s Sakharov Prize, who died in a car crash in Bayamo, Cuba, on July 22, 2012, together with fellow activist Harold Cepero.
In dramatic new testimony by the driver of the car, Ángel Carromero describes, in a Washington Post interview dated 6 March 2013, how their vehicle was followed, harassed and ultimately rammed from behind by a car bearing government license plates. Mr. Carromero further alleges that, following the crash, he was drugged, mistreated and coerced by Cuban authorities into making a false confession.
The new revelations corroborate the claims made by the families of the victims and other witnesses, as well as the report by Spain’s ABC news agency about text messages sent contemporaneous with the incident from the mobile phones of Mr. Carromero and another passenger, Aron Modig, indicating that their car was chased and then hit, causing the crash.
Significantly, according to the family of Oswaldo Payá, state security agents had repeatedly threatened to kill him.
Mounting and credible allegations that the Cuban government may have been complicit in the murder of its most prominent critic, a leading figure in the human rights world, cannot go ignored by the international community.
The families of the victims, and the people of Cuba, have a right to know the truth, and they have a right to justice. This can only happen with the creation of an international and independent inquiry. We therefore respectfully urge you to support our call.

Alert: Carromero Tells-All About Paya's Murder
From The Washington Post:
Ángel Carromero, a leader of Spain’s ruling party, was visiting Cuba last July when a car he was driving crashed, killing Cuban dissidents Oswaldo Payá and Harold Cepero. Mr. Carromero was convicted of vehicular homicide; in December, he was released to Spain to serve out his term. This week he agreed to be interviewed by The Washington Post about the crash. Mr. Carromero, 27, holds a law degree and has taken a business course at Fordham University in New York.
What happened that day?
Oswaldo Payá asked me to take him to visit some friends, since he didn’t have the means to travel around the island. There were four of us in the car: Oswaldo and Harold Cepero in the back, [Jens] Aron Modig [of Sweden] in front, and me driving. They were following us from the beginning. In fact, as we left Havana, a tweet from someone close to the Cuban government announced our departure: “Payá is on the road to Varadero.” Oswaldo told me that, unfortunately, this was normal.
But I really became uneasy when we stopped to get gas, because the car following us stopped, waited in full view until we were finished and then continued following. When we passed provincial borders, the shadowing vehicle would change. Eventually it was an old, red Lada.
And then another, newer car appeared and began to harass us, getting very close. Oswaldo and Harold told me it must be from “la Comunista” because it had a blue license plate, which they said is what the government uses. Every so often I looked at it through the rearview mirror and could see both occupants of the car staring at us aggressively. I was afraid, but Oswaldo told me not to stop if they did not signal or force us to do so. I drove carefully, giving them no reason to stop us. The last time I looked in the mirror, I realized that the car had gotten too close — and suddenly I felt a thunderous impact from behind.
I lost control of the car, and also consciousness — or that is what I believe, because from that point my memories are unclear, perhaps from the medications they gave me. When I recovered consciousness, I was being put into a modern van. I don’t know how it had gotten there, but neither Oswaldo nor Harold nor Aron was inside. I thought it was strange that it was only me, and I figured that the rest of them didn’t need to go to the hospital.
I began to yell at the people driving the van. Who were they? Where were they taking me? What were they doing with us? Then, woozy, I again lost consciousness.
What happened after that?
The next time I awakened, I was on a stretcher, being carried into a hospital room. The first person who talked to me was a uniformed officer of the Ministry of the Interior. I told her a car had hit our vehicle from behind, causing me to lose control.
She took notes and, at the end, gave me my statement to sign. The hospital, which was civilian, had suddenly been militarized. I was surrounded by uniformed soldiers. A nurse told me they would put in an IV line to take blood and sedate me. I remember that they kept taking blood from me and changing the line all the time, which really worried me. I still have the marks from this. I passed the next few weeks half-sedated and without knowing exactly what they were putting in me.
Some text messages were sent from the scene, and there have been reports of others, not yet disclosed. Do you know about them?
They took away my mobile phone when they took me out of the car. I was only able to use Aron’s mobile phone the time we were together in the hospital. I didn’t remember the messages until I arrived in Spain and I read them, asking for help and saying that our car was hit from behind.
How was your statement obtained?
They began to videotape me all the time, and they kept doing so until the last day I was jailed in Cuba. When they questioned me about what happened, I repeated what I told the officer who originally took my statement. They got angry. They warned me that I was their enemy, and that I was very young to lose my life. One of them told me that what I had told them had not happened and that I should be careful, that depending on what I said things could go very well or very badly for me.
Then came a gentleman who identified himself as a government expert and who gave me the official version of what had happened. If I went along with it, nothing would happen to me. At the time I was heavily drugged, and it was hard for me to understand the details of the supposed accident that they were telling me to repeat. They gave me another statement to sign — one that in no way resembled the truth. It mentioned gravel, an embankment, a tree — I did not remember any of these things.
The hit from the back when we left the road didn’t need to be hard, because I remember that there was no curb or incline. The pavement was wide, with no traffic. I especially did not agree with the statement that we were traveling at an excessive speed, because Oswaldo was very cautious. The last speed I saw on the speedometer was approximately 70 kilometers per hour [about 45 miles per hour]. The air bags did not even deploy during the crash, nor did the windows shatter, and both I and the front-seat passenger got out unhurt.
A video of you describing the accident was shown to journalists by Cuban authorities. Under what circumstances was it made?
Once I left the hospital, they took me to a jail in Bayamo. It’s the worst thing I’ve ever lived through. I was held incommunicado, never seeing the light of day. We walked among cockroaches until they put me in the infirmary cell, along with another Cuban prisoner. The conditions were deplorable. A stream of water fell from the roof once a day, the toilet didn’t have a tank, and you could use it only when you had a bucket of water that you could throw afterward into the bowl. The cell was full of insects that woke me up when they fell on my body. Although I remember almost nothing specific from those days, images come to me — and I only wish they were nightmares, and not memories.
The video that the authorities made public was recorded under these conditions. As viewers can see, my face and my left eye are very swollen and I speak like I am drugged. When an officer gave me a notebook in which the official Cuban government account was laid out, I limited myself to reading statements from that notebook. In fact, you can see me reading Cuban expressions I didn’t know, like “transit accident” (in Spain it’s “traffic accident”) , and you can see me direct my gaze to the right corner, which is where the officer stood who held the notes. I hoped that no one would think that the video was freely recorded, or that what I said there corresponded to what really happened.
Who sent you to Cuba? Why did you travel there?
Nobody sent me to Cuba, and I didn’t even tell my boss about my trip. I traveled there during my summer vacation, like so many other supportive people — because I admire the peaceful defenders of liberty and democracy like Oswaldo, who is very well known in Spain.
What do you think about the trial in Bayamo?
The trial in Bayamo was a farce, to make me the scapegoat, but I had to accept the verdict without appeal in order to have the minimal possibility to get out of that hell. However, I decided at the last minute to not declare myself guilty, thinking of Alan Gross [an American contractor sentenced to 15 years in prison for bringing communications equipment into Cuba illegally].
As for the Spanish authorities, I can only thank them for managing to repatriate me. I don’t want to cause any more problems. I want to get my previous life back. I even understand that, even though I am innocent, I have to continue with my liberty restricted due to the bilateral accord between Cuba and Spain. I only hope that this unjust situation will not last for long.
Despite the accusations to which I am daily subjected by the press and by the defenders of the Castro dictatorship, it’s not my intention to go on talking about this traumatic experience. I’ve received death threats in Spain, and I have had to testify before a notary so that at least the truth would be known if something happened to me.
Why are you speaking out now?
The most important thing for me is that the Payá family always has defended my innocence, when they are the most injured by this tragedy. That’s why, when I met Rosa Maria [Payá’s daughter] this week, I could not hide the truth any more. I am not only innocent — I am another victim, who might also be dead now. I know that this decision could result in more brutal media attacks against me from Cuba, but I don’t deserve to be considered guilty of involuntary homicide, and, above all, I could not live, being complicit through my silence.
I don’t know what they gave me in the intravenous line, but I continue to have large memory lapses. What they didn’t manage to make me forget is that Oswaldo is one of the people who most impressed me in my life. He is the true protagonist of this nightmare. He was an exceptional person, and I will never forget him.

In Spain, the Truth Starts to Come Out About Paya “Accident”
By Fabiola Santiago, fsantiago@MiamiHerald.com
At long last, Angel Carromero has broken his silence from the confines of his negotiated parole status in Spain.
He was the woozy-eyed Spanish political activist seen from Havana on a prosecutorial videotape issuing an unconvincing mea culpa that he was driving too fast, that he was at fault for the deaths of two prominent Cuban dissidents in a car crash last summer. Carromero’s “trial” for the deaths of Oswaldo Payá and Harold Cepero was Cuban political theater at its best, a closed-door concoction to cover up wrongdoing — state-sponsored murder? — a tactic Cubans in exile know too well. With Carromero now back in his homeland, the light of truth — tenuous but illuminating — has begun to shine on the deaths of human rights champion Payá and Cepero, the young activist who accompanied the respected leader on a trip across the island to spread the message of peaceful, democratic change.
The car crash in which Payá and Cepero lost their lives on July 22 was no accident, Carromero told Payá’s family in Spain this week. Another vehicle rammed the car Carromero was driving and forced it off the road, he said. While Payá and Cepero, the ones seriously hurt, were left in the car, men in a third car took away Carromero and Swedish politician Jens Aron Modig, another human rights activist accompanying them. “We don’t know what happened to my father and [Cepero] … but hours later they were both dead,” Payá’s daughter, Rosa María, told El Nuevo Herald after her conversation with Carromero.
The Cuban government contends that Payá died instantly and that Cepero died a few hours later in a Bayamo hospital. But they have refused to allow anyone to see the autopsy reports. Modig, at first detained along with Carromero, was allowed to return to Stockholm after Carromero issued his mea culpa. He has remained silent as the Spanish government negotiated Carromero’s return to Spain to serve out his Cuban sentence.
In Cuban custody, the only way to survive is to outsmart the jailers. Carromero and Modig did what they had to to secure their way out of Cuba. But it’s time now to speak up and tell the truth — and for the governments of the European Union, Latin America and the United States to push for an international investigation of the car crash and its aftermath. In a parliamentary hearing Thursday, Spanish government leaders admitted under pressure that they’re in a tenuous situation with Cuba because four Spanish citizens remain in Cuban prisons and they’re negotiating those releases as well. It sounded almost like an admission of blackmail.
Payá and Cepero deserve justice. Both men had been accosted by pro-government mobs, were constantly followed by state security, and had been repeatedly threatened. In fact, Payá didn’t make trips outside of Havana because of the danger, but in the Europeans’ company he felt a measure of safety. A state-sponsored murder is a serious charge, but this is nothing new for a government with a record of dealing violently with the peaceful opposition.

(el-alto-sueño);
le pidieron las piernas
duras y nudosas

¿No me envidias?”.

Has sufrido mucho, hombre, entra, te has ganado el cielo.
