Embargoing Human Rights for Trade? The Sanctions Paradox

Notes from the Cuban Exile Quarter

The Obama Administration has continued to extend a hand to the Cuban regime and has little to show for it, except increased repression, the deaths of high profile activists, and an American citizen rotting in a Cuban prison. There is no reason to suppose that further unilateral concessions will produce a different outcome.

Sanctions are the last nonviolent way of seeking to change an unjust system by refusing to cooperate with tyranny. When discussing the Cuban embargo in the mass media these two aspects are rarely, if ever, touched upon. Academics and the lobbyists for big business, such as USA Engage, often claim that sanctions never work; rather, it is economic engagement that leads towards greater respect for human rights.

However, recent history in China, Burma, and Vietnam indicate otherwise. This disconnect from reality stems from two factors: self-interest and a reading of power dynamics that ignores people power in favor of focusing on regime elites.

In a New York Times article entitled "Easing of Restraints in Cuba Renews Debate on U.S. Embargo," Carlos Saladrigas claims that “maintaining this embargo, maintaining this hostility, all it does is strengthen and embolden the hard-liners . . . what we should be doing is helping the reformers.” Essentially, Mr. Saladrigas argues that lifting sanctions would weaken and dissuade hardliners while at the same time benefiting reformers. Over the past four years the Obama Administration has loosened economic sanctions on Cuba.

If Mr. Saladrigas is correct, we should observe former outsiders in the regime tackling and winning policy discussions, but that has not been the case. On the human rights front the situation has actually deteriorated. One of the policy objectives of the Castro regime both internally and internationally is to portray itself as David against Goliath. Despite having normal trade relations, Hugo Chavez has undertaken the same kind of campaign in Venezuela. Often times the U.S. State Department has fallen short of explaining the sanctions policy fully or for that matter defending it in a vigorous manner at international forums. This has allowed the Cuban government a free hand in a sustained campaign to portray itself as a victim blaming all of its economic woes on the American blockade on Cuba.

Nevertheless as John Adams once observed, “Facts are stubborn things; and whatever may be our wishes, our inclinations, or the dictates of our passion, they cannot alter the state of facts and evidence.” The facts at present demonstrate that the arguments of the regime and its apologists do not hold up under scrutiny. First, one of the problems with the sanctions debate is that words are used interchangeably which are not synonymous while others that should be are not.

For example the Cuban government and many of its apologists use the terms blockade and embargo as if they were the same thing. At the same time the terms embargo and sanctions are viewed as somehow different. A blockade is specifically a military term that according to the Merriam-Webster Dictionary is “for the isolation by a warring nation of an enemy area (as a harbor) by troops or warships to prevent passage of persons or supplies.” In the case of Cuba there was only one time when a blockade was put in place and that was by President John F. Kennedy during the 1962 Cuban Missile Crisis beginning on October 22 and it was ended less than a month later on November 20, 1962.

What is known as the Cuban Embargo began On January 3, 1961 when President Dwight D. Eisenhower suspended trade with Cuba, a few days after his administration broke diplomatic relations with the country. The embargo on Cuba since its inception has meant restrictions on trade and travel to the island by U.S. citizens and in practice has been a partial embargo. Over the decades these sanctions have been loosened and tightened depending on the circumstances at the time.

An actual embargo would mean that there is a complete ban on or prohibition of trade by the United States with Cuba. This is not the case. What you have in Cuba is a partial embargo which is exactly the same in definition as economic sanctions. Between January 2000 and September 2012 according to the United State Census Bureau there has been $4,291,200,000.00 in U.S. trade in goods with Cuba.

The ban on U.S. imports from Cuba remains but U.S. exports to Cuba have been going on since 1992 with the amounts dramatically increasing since 2002 reaching its peak in exports to Cuba under the Bush Administration in 2008. Despite loosening restrictions further under the Obama Administration trade with Cuba has dropped to 363.3 million dollars in 2011 and figures for 2012 show a slight improvement with total sales to the island at $337.5 million as of September. This is not a total embargo but a partial one in which the United States is one of Cuba’s top trading partners.

At the same time Cuban exiles, many committed to maintaining economic sanctions against the dictatorship, are also a main source of remittances to their families on the island totaling hundreds of millions of dollars per year. The aim of the embargo initially, during the Cold War, was to penalize the Castro regime for seizing U.S. properties and limit its ability to fund armed guerrillas and terrorist groups in the region aimed at toppling friendly governments. With the exception of the Sandinistas in Nicaragua in 1979 this policy was a success in the Americas.

Following the collapse of the Soviet Union changes were made to sanctions policies that sought in the 1992 Torricelli Bill and 1996 Helms Burton Bill to make clear that sanctions would remain in effect until all political prisoners were freed, the government tolerated a political opposition and free elections were held. Funds were also set aside by Congress to assist through development assistance independent civil society. In addition Congress in the 1980s established Radio/TV Marti to break the information monopoly of the dictatorship. Also in the late 1980s the United States led an effort at the U.N. Human Rights Commission to expose the systematic human rights abuses on the island and hold the Cuban dictatorship to greater scrutiny.

The result of what amounted to a tightening of sanctions and redirecting them from Cold War considerations to a pro-democracy effort combined with diplomacy was to provide protection to Cuban dissidents on the island, along with the means to reach the populace via radio while also setting up licensing to permit the sending of humanitarian and technical assistance to dissidents by civil society groups in the United States. This led to the growth of the pro-democracy movement on the island and greater support for it internationally.

Policies have consequences

The loosening of sanctions and the lower profile on the international front has meant that the regime has not had to face the same level of accountability that it did back in 2003 for example. During the Black Cuban Spring of 2003 the international community’s response caught the Castro dictatorship by surprise with a sustained campaign to release 75 Cuban prisoners of conscience arrested during the March 18 crackdown and sentenced up to 28 years in prison.

None of the 75 are serving their sentences in a Cuban prison today. So what have we witnessed in Cuba over the past four years? The deaths, under suspicious circumstances, of national opposition figures such as Laura Inés Pollán Toledo and Oswaldo José Payá Sardiñas; The deaths of Orlando Zapata Tamayo and Wilman Villar Mendoza, human rights defenders on hunger strike in the custody of the Cuban authorities; and, an increase both in the number of detentions and the degree of violence used against nonviolent activists.

Over the past four years there has been a dramatic increase in the number of arbitrary detentions in Cuba: from 870 in 2009 to 5,625, thus far, in 2012. One example of this disturbing trend is the death of Juan Wilfredo Soto Garcia from pancreatitis, caused by the brutal beating he received from Cuban government agents.

Another is that of American Alan Gross, arrested on December 3, 2009 and sentenced to 15 years in a Cuban prison. He spent 25 days in a Havana jail before being visited by a U.S. diplomat. By that time Alan Gross had been approached by a Cuban “attorney” who just happened to be representing five Cuban spies imprisoned in the United States for espionage and conspiracy to commit murder. This Cuban attorney represented Alan Gross before his show trial and later appeals. Alan Gross’s supposed crime: Attempting to provide Internet access to the local Jewish community in Cuba. The reality is that he is a pawn of the Castro regime to be used in pressuring concessions from the Obama Administration.

The Administration dangled several offers to the Castro regime and made a unilateral concession
  • Take Cuba off the list of state sponsors of terrorism. 
  • Waive probation for one of five Cuban agents convicted of espionage in the United States that planned at least one terrorist attack in the United States and provided intelligence that led to the downing of two US civilian planes over international airspace on February 24, 1996 killing four.  
  • Cuba democracy programs would no longer be about promoting democracy but "building civil society."
  • The White House and Senator John Kerry pushed to unilaterally cut money for the Cuba democracy programs and freeze their funding. 
On the other side of the ledger the Cuban dictatorship did not suffer any repercussions for arbitrarily detaining a U.S. citizen. Alan Gross remains incarcerated to this day and December 3, 2012 will mark his third year in captivity as an American hostage of the Castro regime. Looking beyond Cuba to China, Vietnam, and Burma, we are presented with a cautionary tale on lifting sanctions unconditionally. In China and Vietnam the United States lifted sanctions, effectively de-linking human rights considerations from economic ones. The result has been a deterioration of human rights standards in both countries. '

In Burma, on the other hand, where sanctions were maintained, there have been signs of improvement in rights protections. The military junta, after years of trying to manipulate its way out from under them, has had to recognize the political opposition and provide a space for them in Burma's parliament. Things are still far from perfect, but there is hope that serious and permanent reforms are underway. The ability of Aung San Suu Kyi to run for public office, and for an independent press to begin to operate in Burma following decades of systematic censorship and control, are both positive signs. Aung San Suu Kyi has been clear about the importance of sanctions and of confronting those that would engage the dictatorship at the expense of the human rights of the Burmese people:
“Investment that only goes to enrich an already wealthy elite bent on monopolizing both economic and political power cannot contribute toward égalité and justice, the foundation stones for a sound democracy. I would therefore like to call upon those who have an interest in expanding their capacity for promoting intellectual freedom and humanitarian ideals to take a principled stand against companies that are doing business with the Burmese military regime. Please use your liberty to promote ours.” 
Prominent Cuban-American businessmen have also spoken out against unconditionally lifting sanctions in Cuba, stating in a letter titled “Commitment to Freedom” that “absent the dismantling of the totalitarian apparatus on the island, along with the unconditional release of all political prisoners and the restoration of fundamental human rights, there should be no U.S. unilateral concessions to the Castro regime." They, like Aung San Suu Kyi believe that it is unprincipled for companies to do business with a dictatorship exploiting the suffering of an oppressed people. Things are improving in Burma on the human rights front, while relations are worsening in China and Vietnam. Linking human rights with economic engagement has been a winning formula in Burma- and there’s hope that it can be in Cuba as well.

Room for improvement

However, there are always opportunities for improving sanctions policies- seeking out approaches that make the people, and not the dictatorship, the priority. For example on August 4, 2011 the Obama Administration announced a ban on visas for people who the State Department finds have been involved in human rights violations. Unfortunately, since then we have seen that human rights violators of the Castro regime are immigrating to the United States. If this ban were applied vigorously to the hardline elements of the Cuban regime it would be positive step that would protect dissidents by holding abusers accountable and providing a penalty, but this ban also needs to be expanded to follow the path taken by the European Union when dealing with the Mugabe regime in Zimbabwe. Banning the relatives of the hard line elements of the dictatorship from visiting the United States would create greater pressures on the regime for change.

Unfortunately, what has gone on in practice is that the children and relatives of the hard liners have an easy time obtaining visas to the United States while the families of dissidents have a more difficult time.

There are two profoundly different visions of how to achieve positive change in Cuba. One views the populace and their representatives in the emerging independent civil society, or dissidents, as the protagonists of change. The second views regime elites and possible reformist elements within the dictatorship as the protagonists for change. The trouble with the latter view is that it often mistakes profiteering with progress, as China has demonstrated. This approach also undermines the morale of dissidents and the populace at large, thus emboldening the dictatorship. History has shown us that change occurs from the ground up. Thus, when sanctions are lifted in an effort to allow elements within the regime to reform, the action actually has the opposite effect. The paradox is that the most effective way to encourage reform is to empower dissidents by pressuring the regime with sanctions. If the current policy of loosening sanctions and not holding the regime accountable for its gross and systematic human rights violation, beyond pro-forma denunciations of atrocity after atrocity then things will get a lot worse and they will never improve for Cubans.

U.S. sanctions policy with regards to the dictatorship in Cuba was about containment of the exportation of the Cuban model throughout the hemisphere, and during the Cold War having Cuba serve as a drain on Soviet resources that contributed to its eventual bankruptcy. In the post Cold War years it shifted once again with a focus on human rights. The failure of the United States to do this in China, Cambodia, Venezuela and Vietnam with their deteriorating human rights situation is not that the policy in Cuba is incorrect as some would claim but that the policies in these other countries are profoundly immoral and ignore human rights concerns.  Instead these policies favor of short-term corporate economic interests that run counter to the interests of the majority of  U.S. citizens not to mention the long term economic well-being of the United States.

De Madre a Madre: "¡LOS DERECHOS HUMANOS SON PARA LOS HUMANOS DERECHOS!"

Hace poco, las madres de PANDILLEROS encarcelados, realizaron una manifestación, exigiendo los  "DERECHOS" de sus hijos. Acá está la respuesta de una  madre ciudadana, hacia la  hacia la madre que protestaba:


DE  MADRE A MADRE:

"Vi tu enérgica protesta delante de las  cámaras de TV, en la reciente manifestación en favor de la  reagrupación de presos y su transferencia a cárceles cercanas a  sus familiares, y con mejores prestaciones.

Vi cómo te  quejabas de la distancia que te separa de tu hijo, y de lo que  supone económicamente para tí, ir a visitarlo como consecuencia de  esa distancia.

Vi también toda la cobertura mediática  que dedicaron a dicha manifestación, así como el soporte que  tuviste de otras madres en la misma situación y de otras personas  que querían ser solidarias contigo, y que contabas con el apoyo de  algunas organizaciones y sindicatos populistas, comisiones  pastorales, órganos y entidades en defensa de los derechos  humanos, ONGs etc. etc.

Yo también soy madre y puedo  comprender tu protesta e indignación.

Enorme es la  distancia que me separa de mi hijo. 

Trabajando mucho y ganando  poco, idénticas son las dificultades y los gastos que tengo para  visitarlo. Con mucho sacrificio sólo puedo visitarlo los domingos,  porque trabajo incluso los sábados para el sustento y educación  del resto de la familia. 

Felizmente, también cuento con el  apoyo de amigos, familia, etc. 

Si aún no me reconoces, yo soy  la madre de aquel joven que se dirigía al trabajo, con cuyo  salario me ayudaba a criar y mandar a la escuela a sus hermanos  menores, y que fue asaltado y herido mortalmente a balazos  disparados por tu hijo. 

En la próxima visita, cuando tú estés  abrazando y besando a tu hijo en la cárcel yo estaré visitando al  mío y depositándole unas flores en su tumba, en el cementerio.  

¡Ah! Se me olvidaba: ganando poco y sosteniendo la economía de  mi casa, a través de los impuestos que pago, tu hijo seguirá  durmiendo en un colchón y comiendo todos los días Y ADEMAS CUANDO SALGA TENDRA SU PAGA PARA QUE NO ROBE DURANTE UN TIEMPO,  O dicho de otro  modo:seguiré sosteniendo a tu hijo malhechor. 

Ni a mi casa, ni  en el cementerio, vino nunca ningún representante de esas  entidades (ONGs), que tan solidarias son contigo, para darme apoyo  ni dedicarme unas palabras de aliento.
¡Ni siquiera para  decirme cuáles son MIS DERECHOS!

Quizás entre todos, podamos  revertir estos valores que existen en nuestro país, donde los  delincuentes, ladrones, terroristas y corruptos tienen más  derechos que los ciudadanos honrados y trabajadores, que sólo  queremos vivir en paz.

International Human Rights Day in Cuba 2012: A look back

The past year has continued to see a deterioration in human rights in Cuba. It began in January with the terrible news that Wilman Villar Mendoza, another prisoner of conscience, had died while on hunger strike in a Cuban prison demanding that his rights be respected. Unfortunately, Pope Benedict's visit to the island in March coincided with a nationwide crackdown on Cuban dissidents while His Holiness was in Cuba. The aftermath has been even worse. Sergio Díaz Larrastegui, died this past April 19, 2012 at the Julio Trigo Hospital in Arroyo Naranjo in Havana, Cuba. He died in the shadows, under the control of Cuban State Security. Less than three months later, Cuban opposition leader and Catholic Layman Oswaldo José Payá Sardiñas along with Harold Cepero from the same movement died under suspicious circumstances that appear to have been provoked by State Security on July 22, 2012. Family and friends are demanding an international investigation into their deaths.
The United Nations conducted a review of torture in Cuba and found much to criticize.
The number of arbitrary detentions in 2012 have skyrocketed compared to previous years. At the beginning of December the number was already at 6,035 detentions.  In November and December of 2012 there were also large scale crackdowns on human rights defenders.
Violence and threats of violence against nonviolent activists and their families continues in Cuba to the present day. An extreme but not atypical example is that of Damaris Moya Portieles who initiated a hunger strike on June 3, 2012 demanding that her 5-year old daughter, Lazara Contreras Moya, be kept safe. This was because state security agents made graphic rape threats to the mother concerning her five year old daughter. The worse of the perpetrators was Eric Francis Aquino Yera. Berenice Héctor González, a 15-year old young woman, suffered a knife attack on November 4, 2012 for supporting the women's human rights movement, The Ladies in White. News of the attack only emerged a month later because State Security had threatened the mother that her daughter would suffer the consequences if she made the assault public. Lady in White Sonia Garro who has on more than one occasion been badly beaten by State Security and her husband have been locked up since March 2012. Unfortunately, when a UN goodwill ambassador visits Cuba to discuss violence against women the above practices by the dictatorship go unaddressed. Dissidents have been beaten up and arrested for addressing national and international bodies.

La policía disuelve violentamente la marcha de las Damas de Blanco

Policías y paramilitares arremetieron este domingo contra las Damas de Blanco en Miramar, La Habana, al finalizar la misa en Santa Rita de Casia.
En el acto de repudio, organizado por el Gobierno, los participantes "golpearon y empujaron a las mujeres", y las introdujeron a la fuerza en tres ómnibus, informó el periodista independiente Roberto de Jesús Guerra Pérez.
En Twitter, la Seguridad del Estado dijo que las autoridades se habían visto en "la necesidad de retirar de la vía pública a las Damas de Blanco, ante [la] respuesta contundente del pueblo".
El reporte añadió que las Damas de Blanco "no han respetado el dolor del pueblo cubano por salud de Chávez".
Según Guerra Pérez, 44 mujeres asistieron a misa este domingo y marcharon, como es habitual, por la Quinta Avenida de la capital.
Unas 30 Damas habían sido detenidas. También se reportaron arrestos e incidentes en Santiago de Cuba, Holguín y Bayamo.
Aunque el régimen atribuye el despliegue represivo a la mala "salud de Chávez", Guerra Pérez cree que las autoridades intentan evitar manifestaciones opositoras en víspera del Día de los Derechos Humanos, que se celebra este lunes.
Los activistas Edelmis Rodríguez Lobaina y Osmestre Bosque fueron arrestados para impedirles organizar una marcha en el Parque Villalón, de La Habana, como tradicionalmente coordinaba el opositor Darsi Ferrer, ahora en el exilio.

Cuba: la posición común europea y el compromiso con los derechos humanos

La posición común sobre Cuba, adoptada el 2 de diciembre de 1996 por la Unión Europea, es un antecedente muy valioso de política exterior en materia de derechos humanos al que sin embargo algunos analistas lo califican como “contraproducente”.
En palabras de Susanne Gratius, investigadora senior de Fride, “la práctica política señala que el condicionamiento y la presión no son instrumentos idóneos para promover la democracia”. Aunque ejemplos como las incesantes presiones internacionales a la dictadura de Augusto Pinochet en Chile o al régimen del apartheid en Sudáfrica que incluía un amplio embargo, refutan lo expresado por la analista del prestigioso think tank español.
Pero aunque la denuncia internacional y los reclamos de apertura política a una dictadura efectivamente no logren sus objetivos, desde la perspectiva democrática es inadmisible aceptar que autoridades ilegítimas, como en este caso las de Cuba, hagan prevalecer sus condiciones y mucho menos ante la Unión Europea, cuyos estados miembro deben garantizar internamente la vigencia de las libertades civiles y políticas.
En el caso de la posición común de la UE hacia Cuba el problema ha sido su incumplimiento y la falta de compromiso internacional con los derechos humanos por parte de muchos de los países -Italia y Francia, por ejemplo- o, en el caso de España, no haber sido adoptada como política de estado de los distintos gobiernos.
En realidad, el único cuestionamiento serio a la Posición Común de la UE sobre Cuba es respecto al punto 3 inciso d, referido a evaluar “la evolución de la política interior y exterior cubana según las mismas normas que aplica la Unión Europea a sus relaciones con otros países, en particular la ratificación y cumplimiento de los convenios internacionales sobre los derechos humanos”. Esto es, la inconsecuencia en no adoptar con otras dictaduras, como China, Arabia Saudita o Bahrein, la misma firmeza que impulsan respecto a Cuba. En todo caso, en lugar de dejar sin efecto la Posición Común de la UE hacia Cuba, sería deseable para la promoción internacional de los derechos humanos, extenderla a países igualmente represivos.
Salvo el mencionado cuestionamiento, cuesta entender la idea de dar marcha atrás frente a una posición comprometidamente progresista que, por ejemplo, establece: “La Unión Europea considera que una plena cooperación con Cuba dependerá de las mejoras en el respeto de los derechos humanos y las libertades fundamentales”. ¿Acaso puede ser otra la política exterior democrática frente a una dictadura?

Nuestro gran reto/ Antonio Rodiles


El arresto arbitrario de la abogada Yaremis Flores el pasado 7 de noviembre fue seguido por dos oleadas, una represiva, llevada a cabo por el régimen contra numerosos activistas de la sociedad civil, y otra, impresionante y que agradecemos, de solidaridad con las víctimas.
En lo personal, lo sucedido reafirmó mi visión del reto fundamental que enfrentamos como país: la articulación de todas sus partes para transitar a una democracia en la que participe toda la nación.
Visualizar y trabajar en pos de una transición hacia la democracia, en el escenario tan enrevesado que vivimos, es un proceso que implica ante todo madurez política e intelectual, honradez, y un alto grado de civismo. Necesitamos comprender que tal dinámica no involucrará un único eje, un único ángulo. No es posible pensar una transición en la que no estén también contemplados todos esos cubanos que hoy habitan en las diferentes esferas del Estado. Tampoco es posible concebir una transición sin la plena participación de aquellos que están fuera de la Isla y que constituyen parte esencial de la nación. No es posible esbozar una transición sin los trabajadores, intelectuales, profesionales y emprendedores que están dentro y fuera de Cuba.
Creer que el cambio en nuestro país sucederá como un pase mágico, que en un abrir y cerrar de ojos generará una sociedad moderna, asentada en un estado de derecho, es una fantasía demasiado simplista y engañosa. Los opositores al régimen totalitario tenemos el deber y la responsabilidad de mostrar a todos los sectores de la sociedad cuál es el proyecto de país plural e incluyente que defendemos, y lo que esperamos de la democracia.
La estrategia del régimen ha sido siempre la misma. Se ha concentrado sistemáticamente en obstaculizar a toda costa el crecimiento de la sociedad civil. Intimidar, reprimir, encarcelar, desangrar el país, generar desconfianza entre la oposición, crear conflictos internos para minar nuestro trabajo, “entretenernos” y así dejarnos poco tiempo para incidir con efectividad sobre la sociedad es una estrategia que le ha reportado frutos y que debe ser desmontada ya. Tenemos que fijar nuestra ética, nuestros presupuestos, nuestro ritmo.
Trabajar en una transición con responsabilidad implica un conocimiento real del escenario que enfrentamos, en el que se manifiesten las particularidades de grupos e individuos desde una perspectiva global. Para garantizar ese abanico de intereses y visiones es necesario que cada cubano goce de sus derechos fundamentales, de ahí la importancia de la campaña “Por Otra Cuba” y nuestra solicitud de apoyo a todos los cubanos y a la opinión pública internacional.
Frente a esta iniciativa ciudadana y pacífica, el gobierno ha respondido con el recrudecimiento de la represión y el uso desmedido de la violencia, dando otro portazo a una nueva propuesta cívica. Sin embargo, este escenario violento comienza a perfilar fracciones dentro de la sociedad: por una parte están quienes, aun dentro del sistema, creen que es posible una nación próspera donde las diferencias políticas e ideológicas sean parte de lo cotidiano, donde prime el respeto y la decencia; por otra, se halla ese segmento enrarecido, conformado por intereses mezquinos, cinismo y bajos presupuestos éticos, que pretende con su actuar irresponsable y prepotente conducirnos a un camino púrpura a manos de la violencia y la brutalidad. Nos toca decidir a los cubanos de qué lado ubicarnos, desde que posición deseamos incidir y actuar.

Intelectuales apoyan a la CIDH frente a Cuba

A través de la organización Cadal, numerosos intelectuales latinoamericanos respaldaron la condena emitida por la Comisión Internacional de Derechos Humanos (CIDH) frente a la ola de detenciones que se vive en la isla.

El organismo había advertido que los arrestos de activistas de derechos humanos son “actos violatorios de los derechos fundamentales de la población consagrados en la Declaración Americana de los Derechos y los Deberes del Hombre, firmada por Cuba”.

Los argentinos Graciela Fernández Meijide (ex secretaria de la Conadep), Luis Alberto Romero (historiador), Daniel Sabsay (jurista) y Thomás Abraham (filósofo); los venezolanos Heinz R. Sonntag (sociólogo) y Andrés Cañizález (periodista); el chileno Patricio Navia (politólogo), entre más de 40 intelectuales, firmaron la solicitada.

“Enviamos nuestra solidaridad a las personas que mediante métodos no violentos promueven la apertura democrática en el país gobernado por la dictadura remanente de América Latina y sumamos nuestro apoyo al pedido de la CIDH”, sostuvieron.

Señalaron que “las restricciones a los derechos políticos, a la libertad de expresión y de difusión del pensamiento, la falta de elecciones, la falta de independencia del Poder Judicial y las restricciones al derecho de residencia y de tránsito configuran una situación permanente de transgresión de los derechos fundamentales”.

Represion y Lucha No Violenta Activa

mientras la Sociedad Interamericana de Prensa [SIP] que representa a 1,300 agencias del continente da a conocer la carta  enviada a Raul Castro exigiendole respeto a la integridad de Yoani Sanchez y su familia; la Comision Interamericana de Derechos Humanos [CIDH] condena  la ola de detenciones "arbitrarias" de defensores de derechos humanos e instó al gobierno de Raúl Castro a tomar medidas para "prevenir" y "erradicar" el hostigamiento contra quienes ejercen el derecho de reunión.
y si bien estos pronunciamientos internacionales que no siendo ineditos son importantes, lo que marca un giro es la reaccion de un grupo heterogeneo  de disidentes [que cubre un amplio diapason desde un escritor como Angel Santiesteban hasta un opositor encarcelado durante la Primavera Negra como Angel Moya] de protestar frente a la Unidad policial de Acosta en el municipio 10 de octubre de La Habana, por el arresto arbitrario de Antonio Rodiles, quien se encontraba en esta unidad, porque eso es "Lucha no violenta activa".

UN Committee blasts Cuba for human rights 'abuses'

GENEVA, Switzerland, June 3, CMC – The United Nations Committee Against Torture has blasted Cuba’s Raúl Castro administration for an alleged string of human rights abuses, including an increasing wave of political detentions, poor prison conditions, and the use of isolation, sleep deprivation and other coercive interrogation tactics.
In a strongly-worded 6,000-word report, issued here on Friday, the panel said the socialist government in Havana provided few or none of the details about specific allegations of abuses that it had requested.
The panel said it was “concerned by reports denouncing the use of coercive methods during (police) interrogations, particularly the denial of sleep, detention under conditions of isolation and exposure to sudden changes in temperatures”.
It said it was “supremely concerned by the reports received about the overcrowding, malnutrition, lack of hygiene and healthy conditions (and) adequate medical attention” in Cuban prisons.
The UN panel said it had received thousands of complaints of short-term detentions of dissidents, singling out José Luis Ferrer García and Oscar Elias Biscet.
Cuban officials also never explained the deaths of dissidents Orlando Zapata Tamayo and Juan Wilfredo Soto García, the panel said.
But the report acknowledged Havana’s apparent approval of a request for a visit by the UN’s Special Rapporteur on torture and other physical abuses, a key UN investigator who reports to the UN Commission on Human Rights. There was no indication as to when the visit would occur.
And the UN praised the Communist Party government for signing four international agreements on the rights of children and disabled persons and banning “forced disappearances,” approving a multi-year plan to fix up prison facilities and working to reduce family violence.
The body urged Cuban authorities to establish an independent body to gather, investigate and report on allegations of government abuses, and meet its promise to allow a visit by the UN’s top official on several types of mistreatments.
The report urged Havana “to investigate, without delay, exhaustively, without bias and in an efficient way, all deaths of prisoners”.
Cuban officials told the panel that prison officials were not responsible for any of the 202 such deaths in 2010-2011, but gave no further information.
The report also condemned Cuba for the rapid increase in the use of short-term arrests of dissidents without any judicial orders, usually to keep opposition activists away from activities. Critics say a highlight of this tactic was the jailing of dissidents just before Pope Benedict XVI’s visit to Cuba in April.
But Cuban officials told the panel last month that all detentions follow due process but human rights campaigners in Cuba have said the number of arrests doubled from 2010 to 2011.
The panel also condemned the “restrictions on freedom of movement, invasive security operations, physical aggressions and other acts of intimidation and harassment presumably committed by the National Revolutionary Police or members of the Organs of State Security.”
It said Cuba should also abolish vaguely-worded crimes, such as “pre-criminal social dangerousness” and halt the “acts of repudiation” by pro-government mobs against dissidents like the Ladies in White and Cuban Patriotic Union “with the presumed connivance of police authorities”.
The report urged that persons detained should be allowed immediate access to independent defence lawyers and doctors, as well as relatives.
It said the government should also guarantee the independence of the justice system and resolve gaps in its due process regulations.
The report also repeatedly complained that Cuba had provided little or none of the detailed information the panel had requested on some issues, specifically the deaths of Zapata Tamayo after a long hunger strike and Soto Garcia after an alleged police beating.
Cuba provided no details on the 202 prison deaths — “a number the committee considers to be high” — or the 46 prison officials and guards that the government claimed had been put on trial and convicted for abuses. It claimed there’s no prison overcrowding, but gave no numbers.
The committee “laments the reticence of the government to present complete information” on the short-term detentions. Cuba also presented no information on people convicted of “crimes against the security of the state” — usually viewed as political prisoners.

For Brookings [Institution], Human Rights Are Optional

Last week, we posted how the Brookings Institution seemed to have difficulty differentiating between being a "think-tank" and being "in-the-tank" -- as it hosted Castro's official historian Eusebio Leal (or as regular Cubans call him, Eusebio "el Leal," Eusebio "the loyal one") to promote tourism to the island.

Yesterday, Brookings decided to even further discard its integrity.

It hosted four academics -- two from the U.S. and two from Cuba -- to propose joint recommendations for "improving ties between the two countries."

The panel was entitled, "Overcoming Obstacles to U.S.-Cuba Dialogue: Joint Recommendations from Cuban and American Scholars."

Of course, all four academics were already "in-the-tank" for the Castro regime's talking points, so there was never any real disagreement to begin with.

Their recommendations encompassed five areas:

1. Greater academic collaboration (for the regime's agenda).
2. Expanded travel (for the regime's coffers).
3. More business exchanges (for the regime's military).
4. A dialogue about terrorism (for the regime's absolution).
5. And oil-environmental talks (for they haven't gotten the memo that Repsol's drilling was a bust, again).

Yet, no mention of the only real obstacle to better U.S.-Cuba relations (or more importantly, Cuban-Cuban relations):

The Castro regime's utter disrespect for the fundamental human rights of the Cuban people.


You know, the Cuban people's rights as human beings.

Those encapsulated in the Universal Declaration of Human Rights -- that brilliant document which the Castro regime imprisons Cubans for possessing.

But that's not on Brookings agenda.

The U.S. Administration's View [on Cuba]

From a speech this week by Asst. Secretary of State for the Western Hemisphere, Roberta Jacobson:

Let me add a point about Cuba. We have a positive policy, one that seeks to support Cubans’ rights to freely determine their own future. The Administration has done a great deal to ease travel restrictions and increase the flow of information for ordinary Cubans. And we will be the first to cheer as a democratically chosen government in Cuba resumes its full participation in the inter-American system. But you all know that we aren’t there yet. This region has a long consensus that participation hinges on adherence to democratic norms and principles. Personally, I found it disappointing at times that some countries whose democratic transitions have been so central to their own national success, and who are stalwart in their support for rights and democracy on the global stage, wavered in this case.

We have a general concern about an erosion of full respect for freedom of expression in this hemisphere. During the remarkable transitions from dictatorship to democracy which took place over the last 40 years, our region’s free press has played essential roles. From La Prensa’s principled defiance of abuses from the right and the left in Nicaragua to the courageous journalists of El Espectador who exposed links between narcotics traffickers and politicians in Colombia, to today’s valiant bloggers and journalists in Mexico, journalists in this region have been protagonists of democracy. We’ve also developed institutions unique in the world to protect and defend freedom of expression.   More >>

When the Pope doesn't care: Cuba Religious Freedom Violations Continue

But the Vatican, the Pope and the Cardinal Ortega's corporation don't care.

Serious religious freedom violations continue in Cuba despite some improvements. Violations by the Cuban government include: detention, sporadic arrests, and harassment of clergy and religious leaders, as well as interference in church affairs. The Cuban government also controls and monitors religious belief and practices through surveillance and legal restrictions.

Background

The Cuban government largely controls religious denominations through government-authorized surveillance and harassment, and at times detentions, of religious leaders and through its implementation of legal restrictions. The government requires churches and other religious groups to undergo an invasive registration procedure with the Ministry of Justice. Only registered religious communities are legally allowed to receive foreign visitors, import religious materials, meet in approved houses of worship, and apply for travel abroad for religious purposes. Local Communist Party officials must approve all religious activities of registered groups. The government also restricts religious practices by: denying the construction or repair of houses of worship; denying access to state media and exit visas; requiring the registration of publications; limiting the entry of foreign religious workers; denying Internet access to religious organizations; denying religious literature, such as Bibles, to persons in prison; denying permission to hold processions or events outside religious buildings; and discriminating on the basis of religion in the area of employment.

Can the Pope bring hope to Cubans? [Washington Post‎ Editorial]

HOW IS CUBA preparing for the visit next week of Pope Benedict XVI? By rounding up dissidents, of course.
Four score or so were detained over the weekend, including the leaders and most of the members of the Ladies in White, the group that regularly marches in support of political prisoners. Many were released Monday, but they can expect regular harassment in the coming days. The regime’s practice is to carry out short-term arrests rather than formal imprisonments: According to the Cuban Commission for Human Rights and National Reconciliation, there were more than 600 such detentions in February alone.
If Pope Benedict or the Cuban Catholic hierarchy under Cardinal Jaime Ortega is troubled by this, they don’t show much sign of it. So far, the pontiff has not responded to appeals by the Ladies in White and other dissident groups seeking a few minutes of his time during the three days he will spend in Cuba. He has, however, scheduled two meetings with Raul Castro and made it known that he will be “available” if Fidel Castro wishes to meet with him. Cardinal Ortega, for his part, asked police to expel 13 dissidents who were camped in a Havana church last week in an attempt to push the pope to talk to the Castros about human rights.
The church’s coldness toward peaceful pro-democracy activists isn’t all that surprising. Since 2009, Cardinal Ortega has become a de facto partner of Raul Castro, meeting with him regularly and encouraging his limited reforms. The church helped broker the release of more than 100 political prisoners and did not object when most were pressured into emigrating to Spain. The cardinal has lobbied in Washington for the relaxation of U.S. sanctions against Cuba; the pope himself gave a speech Friday calling for the lifting of the U.S. trade embargo. Pope Benedict’s visit, the first by a pontiff since John Paul II toured the island in 1998, seems aimed at reinforcing what the church sees as a gradual process of peaceful reform led by the regime.
The problem is that, as Raul Castro has made clear, liberal democracy plays no part in his strategy. Rather, he hopes that Cuba will follow the path of Vietnam or China, opening its economy enough to stabilize a one-party regime. That may work for Cardinal Ortega, but it won’t satisfy Cuba’s opposition. Some 750 activists sent a letter to Pope Benedict warning that his visit “would be like sending a message to the oppressors that they can continue to do whatever they want, that the church will allow it.”How could Pope Benedict avoid sending that message? He could meet with the Ladies in White. He also could press the Castros to stop persecuting democratic activists and release those who remain in prison. That should include the American Alan Gross, who is serving a 15-year prison term for delivering computers and satellite Internet connections to Cuba’s Jewish community as a contractor for the U.S. Agency for International Development.
The Vatican is right to support change in Cuba but wrong to suppose that it will happen without greater pressure on the regime and cooperation with peaceful opponents.

Senado de EE.UU. condena a Cuba

En honor a la vida del fallecido activista por la democracia en Cuba, Wilman Villar Mendoza, y de condena al régimen castrista, fue aprobada por consenso unánime y sin enmiendas una resolución en el Senado de los Estados Unidos.
La resolución insta al Consejo de Derechos Humanos de la ONU a suspender a Cuba de sus cargos en ese órgano; a la Asamblea General, a que vote para suspender los derechos de membresía de La Habana en el Consejo; y a la comunidad internacional y los gobiernos democráticos a condenar el acoso y la represión violenta de activistas pacíficos por parte del régimen de Raúl y Fidel Castro.
