Top Senate Dems Urge Obama to Take Unilateral Action on Debt Ceiling

Top Senate Democrats say, go for it.
The White House has dismissed talk that Obama would rely on unusual measures to raise the nation's debt limit without Congress' approval, but administration officials also have warned that the country could default on its debt and trigger a new economic crisis if lawmakers don't increase the limit on borrowing.
Senate Majority Leader Harry Reid, D-Nev., is among those urging Obama to consider options like invoking the 14th Amendment to the Constitution to find ways around the $16.4 trillion legal cap on government borrowing. The amendment states that the "validity of the public debt of the United States ... shall not be questioned," which some lawmakers believe permits a way out of the debt limit jam.
The government hit the debt limit last month and is juggling the books to buy additional time for Congress to act. But those moves only buy a few weeks of wiggle room, which requires Congress to act -- likely by mid- to late-February -- to avoid a market-quaking default on U.S. obligations.
The White House has said emphatically that it does not believe that the 14th Amendment permits Obama to ignore the debt cap on U.S. borrowing, though it considered the question during the 2011 debt crisis.
"There is no Plan B. There is no backup plan," White House spokesman Jay Carney said Wednesday. "There is no alternative to Congress raising the debt ceiling."
A letter to Obama on Friday from Reid and Sens. Dick Durbin, D-Ill., Chuck Schumer, D-N.Y., and Patty Murray, D-Wash., doesn't mention the 14th Amendment, but aides to the senators said that's what they have in mind in urging the president to consider unilateral action.
"We believe you must be willing to take any lawful steps to ensure that America does not break its promises and trigger a global economic crisis -- without congressional approval, if necessary," the letter said.
Battling House and Senate leaders have made virtually no progress on a strategy for legislation to lift the debt cap. House Speaker John Boehner, R-Ohio, insists that any debt increase be matched by equivalent spending cuts. Obama, buoyed by his re-election victory, says he won't negotiate as he did in 2011, when he traded a $2.1 trillion debt increase for tight spending limits on agency budgets and automatic, across-the-board spending cuts if a congressional "supercommittee" failed to reach a budget agreement.
"Senate Democrats cannot ignore their responsibilities for political convenience -- and the American people will not tolerate an increase in the debt limit without spending cuts and reforms," said Boehner spokesman Michael Steel.
The impasse has people on both sides scratching their heads over how it will be resolved. The anxiety is such that some on the left are urging Obama to mint a coin worth perhaps $1 trillion to be deposited at the Federal Reserve and drawn upon to meet government obligations.

Details of Tentative Deal
Highlights include:
--Income tax rates: Extends decade-old tax cuts on incomes up to $400,000 for individuals, $450,000 for couples. Earnings above those amounts would be taxed at a rate of 39.6 percent, up from the current 35 percent. Extends Clinton-era caps on itemized deductions and the phase-out of the personal exemption for individuals making more than $250,000 and couples earning more than $300,000.
--Estate tax: Estates would be taxed at a top rate of 40 percent, with the first $5 million in value exempted for individual estates and $10 million for family estates. In 2012, such estates were subject to a top rate of 35 percent.
--Capital gains, dividends: Taxes on capital gains and dividend income exceeding $400,000 for individuals and $450,000 for families would increase from 15 percent to 20 percent.
--Alternative minimum tax: Permanently addresses the alternative minimum tax and indexes it for inflation to prevent nearly 30 million middle- and upper-middle income taxpayers from being hit with higher tax bills averaging almost $3,000. The tax was originally designed to ensure that the wealthy did not avoid owing taxes by using loopholes.
--Other tax changes: Extends for five years Obama-sought expansions of the child tax credit, earned income tax credit, and an up to $2,500 tax credit for college tuition. Also extends for one year accelerated "bonus" depreciation of business investments in new property and equipment, a tax credit for research and development costs and a tax credit for renewable energy such as wind-generated electricity.
--Unemployment benefits: Extends jobless benefits for the long-term unemployed for one year.
--Cuts in Medicare reimbursements to doctors: Blocks a 27 percent cut in Medicare payments to doctors for one year. The cut is the product of an obsolete 1997 budget formula.
--Social Security payroll tax cut: Allows a 2 percentage point cut in the payroll tax first enacted two years ago to lapse, which restores the payroll tax to 6.2 percent.
--Across-the-board cuts: Delays for two months $109 billion worth of across-the-board spending cuts set to start striking the Pentagon and domestic agencies this week. Cost of $24 billion is divided between spending cuts and new revenues from rules changes on converting traditional individual retirement accounts into Roth IRAs.
Republican House leaders voice serious concerns over fiscal bill
Doubts that the GOP-controlled House would pass the plan intensified Tuesday afternoon. Lawmakers have just two days to go before a new Congress convenes which limits the House’s options. The House can reject the plan, pass it as written by the Senate – which is unlikely given strong GOP opposition – or amend it. If the House amends it, the legislation goes back to the Senate where time constraints would likely kill it for the current Congressional session.
GOP lawmakers privately met midday Tuesday to gauge support for the accord. While Republican lawmakers expressed concern about the plan they did not directly speak out against it. Instead, Fox News has learned that House Speaker John Boehner held a venting session where members of his party voiced their concern about the legislation. Members also offered up options on what they’d like to see added in or taken out of the bill.
As Boehner listened to Republicans, Vice President Joe Biden listened to what House Democrats had to say. The outcome of Tuesday’s mini-meetings are not yet known. What is known is that time is running out for lawmakers to approve the plan or make meaningful changes to the one passed by the Senate this morning.
The Senate’s plan would prevent taxes from going up on the poor and middle class but would raise rates on households making more than $450,000 a year. It also would also put off for two months more than $100 billion in automatic spending cuts that were set to hit the Pentagon and domestic programs starting this week, and it would extend unemployment benefits for the long-term unemployed.
The Senate voted 89-8 in favor of the package two hours after midnight.
Senate leaders hailed the deal as an “imperfect” but vital solution to the fiscal crisis.
“The president wanted tax increases, but thanks to this imperfect agreement, 99 percent of my constituents won’t be hit by those hikes,” Senate Republican Leader Mitch McConnell said.
Obama praised Senate lawmakers for passing the bill and implored the House to do the same.
"There’s more work to do to reduce our deficits, and I’m willing to do it," Obama said in a statement. "But tonight’s agreement ensures that, going forward, we will continue to reduce the deficit through a combination of new spending cuts and new revenues from the wealthiest Americans."
Senate leaders assembled the vote after a marathon weekend of talks during which Vice President Biden and McConnell did much of the hard bargaining. After the White House and Senate Republicans agreed to the framework, Biden was brought in once more to sell the deal to reluctant Senate Democrats Monday night.
The late-night deal ironed out the last major sticking point between the two sides -- what to do about the $110 billion in automatic spending cuts set to kick in starting in January.
Officials said the two sides agreed to postpone the cuts by two months, in exchange for a 50-50 mix of revenue increases and spending cuts. Of those cuts, half would come from defense and half would come from other budgets.
Fox News has also learned the deal contains a repeal of an ObamaCare program called the CLASS Act. The provision, which would set up a government-run long-term care program, was never actually implemented amid concerns that it couldn't generate enough revenue to sustain itself.

Reid said, “we had a constructive meeting. We certainly hope that something positive will come from that. The republican leader and I and our staffs are working and we’ll see what we can come up with. We shouldn’t take a long time to do that. …
“If we come up with something, it’s not that easy. We’re dealing with big numbers and some of the stuff that we do is somewhat complicated. But I think it was a very positive meeting,” he said. “There was not a lot of hilarity in the meeting, everyone knows how important it is. It was a very serious meeting and it took an extended period of time as you all know waiting for us.”
McConnell spoke immediately after Reid, saying, “I share the view of the majority leader. We had a good meeting down at the White House.
“We are engaged in discussions, the majority leader and myself and the White House, in the hopes that we can come forward as early as Sunday and have a recommendation that I can make to my conference and the majority leader [Reid] can make to his conference and so we’ll be working hard to try and see if we can get there in the next 24 hours,” he said. “And so I’m hopeful and optimistic.”
Boehner’s office issued a statement which said he “reminded the group that the House has already acted to avert the entire fiscal cliff and is awaiting Senate action.”
“The leaders spent the majority of the meeting discussing potential options and components for a plan that could pass both chambers of Congress,” the statement read. “The Speaker told the President that if the Senate amends the House-passed legislation and sends back a plan, the House will consider it – either by accepting or amending. The group agreed that the next step should be the Senate taking bipartisan action.”
In a paper statement, McConnell’s office also pointed to legislation which had passed the House.
“While the House already passed legislation in August to prevent tax hikes (a proposal Sen. McConnell supports), the President and Congressional leaders today agreed that the Senate must now act,” the statement read. “This will require a bipartisan approach. Members of the Senate will continue to work toward producing a bipartisan package in a timely manner to protect American taxpayers and jobs from a massive tax hike in January.”
Pelosi said the meeting was "constructive" and "candid."

But perhaps most important of all, it’s not clear that it’s in the interest of the conservative Republicans leading talk of the coup to dive into the messy business of making deals with a Democratic president and Senate, or assuming responsibility for the 2014 midterm elections.
“I’m not,” Boehner said Friday, asked whether he was worried about his speakership following the collapse of his attempt to rally Republicans around an alternative tax increase plan to President Obama’s. “They weren’t taking that out on me — they were dealing with the perception that they were raising taxes,” he said.
In theory, a coup is possible: many conservatives would gleefully support such a move — and few Democrats would shed a tear. And it would only take a handful of his conference to throw the election for speaker into chaos. As National Journal points out, it would take just 17 Republicans voting for anyone other than Boehner to throw the election into chaos.
But while he may have lost control of his conference, Boehner has a lot of reasons to not be worried about actually losing the speakership when the House convenes January 3rd to hold elections.
