La recomendacion del Senador Leahy a Obama: EE UU tiene que dar para recibir en el caso Gross

Un prominente senador estadounidense que acaba de realizar una visita a Cuba dijo este domingo que es necesario que Washington y La Habana den y reciban algo para obtener la liberación del contratista norteamericano Alan Gross, condenado en la Isla a 15 años de cárcel, informa la AFP.
Patrick Leahy, que dirige la comisión de Justicia del Senado, se reunió con Raúl Castro y pudo ven a Gross durante su visita la semana pasada a la Isla.
En declaraciones al programa State of the Union, de la cadena CNN, Leahy dijo que la presión de Estados Unidos no funcionará con Cuba. Gross "no será liberado por los cubanos por la presión de Estados Unidos", señaló.
"Hay formas de que sea liberado, pero requerirán alguna forma de toma y daca de ambas partes y una negociación silenciosa", dijo.
Si cada parte deja de mirar a la otra con mentalidad de la Guerra Fría, "creo que podemos encontrar soluciones, no solo al tema de Alan Gross, sino a una serie de otros temas", agregó el senador.
Como ejemplo, Leahy consideró que "no tiene sentido" mantener a La Habana en la lista de estados que fomentan el terrorismo. Argumentó que en la Isla se están desarrollando las conversaciones de paz entre el Gobierno colombiano y las narcoterroristas Fuerzas Armadas Revolucionarias de Colombia (FARC).
Para Leahy, el embargo de Estados Unidos a Cuba es otro de los temas que puede ser revisado.
Gross, de 63 años, fue detenido en diciembre de 2009 y acusado de distribuir equipos prohibidos de comunicación en la Isla como parte de un programa de la Agencia de Estados Unidos para el Desarrollo Internacional destinado a promover la democracia en Cuba.
El Gobierno de Raúl Castro lo condenó por "actos contra la independencia y la integridad territorial" del Estado.
A cambio de Gross, La Habana busca que Estados Unidos libere a sus cinco agentes condenados en ese país por espionaje.

U.S. Congressional Delegation Leaves Cuba Empty-Handed [by now]

(Reuters) - A U.S. congressional delegation left Cuba on Wednesday after meetings with President Raul Castro and other top officials, but no sign the countries had resolved their latest dispute: the fate of imprisoned U.S. contractor Alan Gross. Delegation members and their staff said they were encouraged by the relaxed tone of their meetings and indications the Cuban side wanted the dialogue to continue.
Democratic Senator Patrick Leahy of Vermont canceled a news conference scheduled for Wednesday morning before taking a stroll with his wife in downtown Havana then leaving for Haiti. "We met with President Raul Castro and discussed the continuing obstacles and the need to improve relations between our two countries," he said in a brief statement. Leahy said upon arrival in Cuba on Monday that he had spoken with President Barack Obama about the trip and would report back to his administration. He said the delegation hoped the imprisoned U.S. contractor would fly home with them, but added it was a long shot. Leahy and U.S. Representative Chris Van Hollen, a Democrat who represents Gross' district in Maryland, visited the American contractor on Tuesday at a Havana military hospital where he is being held, a U.S. diplomat told Reuters. They had no comment on the visit.
Other members of the delegation included Republican Senator Jeff Flake of Arizona and Democratic Senators Debbie Stabenow of Michigan, Sherrod Brown of Ohio, Sheldon Whitehouse of Rhode Island and Democratic Representative Jim McGovern of Massachusetts.
Leahy led a similar delegation to Cuba a year ago.
Gross, 63, was arrested in Havana in December 2009 and sentenced to 15 years in prison for installing Internet networks under a secretive U.S. program the Cuban government considers subversive. The United States insists Gross was merely helping the local population get connected as part of a democracy-building project. The case halted a brief detente in long-hostile U.S.-Cuba relations that marked the first months of Obama's presidency.
Cuba has linked Gross' fate to that of five Cuban agents imprisoned in the late 1990s for infiltrating Miami exile organizations and U.S. military bases. The agents, known as the Cuban Five, were sentenced to long terms, ranging from 15 years to life. They are considered heroes in Cuba, where more than a dozen exile-orchestrated attacks on international tourism facilities occurred in the 1990s.
The U.S. delegation was the first since Obama was re-elected and came just days before Castro was expected to be named for a second term on Sunday. Castro replaced his ailing brother, Fidel, as president in 2008. Despite political tensions that have led to the suspension of immigration and other talks, the two leaders have presided over an improvement in people-to-people contact, increased flows of cash remittances from Cuban Americans and continued U.S. food sales for cash.
Between 450,000 and 500,000 Cuban Americans and Americans visited Cuba last year, according to tourism industry sources, and food sales increased by $100 million to $457 million, making the United States one of Cuba's top 10 trading partners and its second-largest provider of tourists after Canada.
This week's visit by the U.S. lawmakers represented the latest failed effort to obtain Gross' release. U.S. Secretary of State John Kerry, when he was a senator from Massachusetts, met with Cuban Foreign Minister Bruno Rodriguez in New York in 2010 to discuss the Gross case, according to Foreign Affairs magazine. Former President Jimmy Carter also met with Raul Castro on the matter during a visit to Havana in 2011. The Obama administration has said relations will not improve while Gross remains in custody. Under the 1996 Helms-Burton Act, U.S. sanctions cannot be lifted until Cuba's one-party Communist political system is changed, a demand rejected by the Cuban government.

Why Appeasing Havana Won't Free Alan Gross

In "Our Man in Havana," R. M. Schneiderman suggests that Alan Gross will not be freed from his Cuban prison unless the U.S. State Department shuts down its programs supporting democracy and human rights in Cuba. This conclusion is faulty, if not utterly ridiculous. Gross, who worked for a U.S. Agency for International Development (USAID) contractor, is serving a 15-year jail sentence for trying to help Havana's Jewish community connect to the Internet, an act most of the world does not recognize as a crime. In 2009, Gross was seized just before he was scheduled to fly home to the United States and held for 14 months before any charges were filed against him. Former U.S. Ambassador to the United Nations Bill Richardson has aptly described him as a "hostage."

What seems to gall Schneiderman is not Gross' imprisonment, but rather that Congress mandated the democracy-promotion program in Cuba in the first place. Schneiderman characterizes the U.S. government's continuation of such programs as a failed opportunity to do away with "the antiquated politics of the Cold War." He is correct that the programs are modeled on those that successfully cracked the Iron Curtain and that, after the collapse of European communism, were wholeheartedly endorsed by Lech Walesa, Václav Havel, and others. But he is wrong to call the program "antiquated" when Cuba remains a Stalinist-style state. The programs' fundamental goal remains to break through the Castro regime's control of information that isolates the Cuban people and keeps them in bondage.

That the democracy-promotion program annoys the Cuban regime does not make it a failure of U.S. foreign policy. In fact, there is no evidence to support Schneiderman's claim that canceling the program would have freed Gross or produced other tangible benefits.  The author recounts a 2010 conversation between Fulton Armstrong, a senior adviser to the U.S. Senate Foreign Relations Committee, and "high-level Cuban officials." Armstrong is quoted as telling the Cubans that the democracy programs were "stupid." He continued, "We're cleaning them up. Just give us time, because politically we can't kill them." Armstrong then asked, "Will this help you release Alan Gross?" to which he believes the Cubans said yes. This misses the fact that when it comes to Cuba, only two people are empowered to say yes -- Raúl and Fidel Castro. And the Castros have a long history of biting any hand of friendship extended to them.

Indeed, even though Congress placed a hold on funding for the democracy program in 2010, Gross was tried and sentenced in March 2011. Washington may have had other reasons to think Cuba would be releasing Gross, but he did not come home with either former President Jimmy Carter nor Richardson, both of whom traveled to Havana.

By now, this story should be all too familiar. As president, Carter attempted reconciliation, establishing the U.S. Special Interests Section in Havana and making efforts at establishing some form of diplomatic relations. Castro's response was to export thousands of prison inmates and patients from insane asylums to Florida, to send Cuban troops to fight a war in Angola in support of Soviet interests, and to assist anti-American insurgencies in Central America. Later, when U.S. President Bill Clinton again sought to improve relations, Fidel ordered two unarmed, civilian American aircraft shot down over the Straits of Florida in international waters. In response to U.S. President Barack Obama's attempts to reduce the animosity between the two countries by easing trade restrictions and lifting limits on remittances, Raúl Castro -- who has taken over for Fidel -- not only ignored the president's suggestion that Cuba reduce its taxes on remittances but also jailed Gross.

Gross is not the only person who has been punished for supporting human rights on the island. The regime has detained and expelled many visitors who dared to meet with dissidents. Among them were the current foreign minister of the Czech Republic; a cabinet secretary from Spain; Dutch, German, and European parliament members; journalists; and human rights activists. Gross' imprisonment -- set against the background of the continued repression of Cubans, the harsh punishment meted out to dissidents, and the refusal to allow prison inspections by international organizations -- should serve as a wake-up call to those proposing unilateral concessions for the sake of normalization with Havana. Appeasement does not discourage the bad behavior of dictators; it emboldens it.

The time to normalize U.S. relations with Cuba will come only when Havana begins taking steps toward democracy and a free-market economy and reconsiders its alliances with North Korea, Syria, and other U.S. adversaries. Releasing Gross would be one indication that Cuba is ready to change. Obama ought to tell Raúl Castro that the United States holds him personally responsible for Gross' well-being. Similarly, policy decisions that have increased and allowed remittances and encouraged American tourists to travel to the island can be reversed and revisited. Cuba has always played hardball, and if Castro's government wants to continue its ways, the United States is not without rackets.

Self-Admitted Former Spy Calls For Alan Gross Negotiation

The case of Alan Gross, an American development expert sentenced by Cuba to fifteen years in prison for “acts against the independence or the territorial integrity of the state", is the latest instalment (sic) in the tense story of Cuba-US relations. Negotiating is the only way to break the cycle.
Last year, in the Foreign Affairs Committee of the US House of representatives, Rep. David Rivera (R-FL) demanded that Wendy Sherman, undersecretary of state for political affairs, reveals whether the US somehow tried to negotiate with Havana, the release of Alan Gross. Mr.
Gross is an international development expert who worked for a contract of the US Agency for International Development (USAID) and is serving a fifteen year prison sentence in Cuba, condemned for participating in acts against Cuban sovereignty and political integrity.
Gross entered Cuba five times as a non-registered foreign agent. His mission, as a USAID subcontractor, was to create a wireless Internet network that would circumvent Cuban government detection. The USAID program was approved under section 109 of the Helms-Burton Act, a law committed to regime change in Cuba. Gross’ actions were covert. He never obtained the informed consent of the Cuban Jewish community, which has always expressed opposition to the Helms-Burton law, particularly its attempt to politicize religious communities as tools to promote opposition groups.
Mr. Gross didn’t know Cuba and didn’t speak Spanish. Gross loved Cuban music but that is hardly a qualifier for the type of covert mission he was recruited for by Development Alternatives Initiatives (DAI), a contractor for the US government. A clear indication of the lack of professionalism of the USAID Cuba program is its recently declassified listof go-to sources of information about Cuba headed by the website Babalu Blog. You don’t need to be a Cuba expert to realize that the Babalu blog is hardly eduational (sic) on Cuba but disseminates right wing propaganda against every Cuban American or American who disagrees with its writers’ McCarthyism. Accordingto Babalu Blog, for example, President Obama is a “Marxist tyrant” in the “Stalin-Mao-Castro tradition”.
Questioning the Obama administration, Republican congressman Rivera said: "It is outrageous that the Obama administration would be negotiating with a terrorist regime to free an American hostage."
This policy is correct: the US should not give in to the demands of terrorists. That would only encourage them to take further hostages. But this has nothing to do with Gross or Cuba.
Rivera's references to terrorism are a manipulation. The State Department has not recorded a single terrorist act sponsored by Cuba in two decades. Recently, Havana hosted another round of negotiations between the FARC guerrillas and the Colombian government of Juan Manuel Santos. The Colombian government not only appreciated Cuba’s facilitation of the conversations but also demanded that Havana be included in the next Summit of the Americas. In Spain, the other country supposedly a target of groups protected by Cuba, the ETA has demobilized and successive socialist and popular governments have thanked Havana for receiving freed commandos of the Basque organization.

Los 10 viajes de ALAN GROSS: Cuando los negocios con el tema de Cuba no se terminan a tiempo

Cada año, varias veces en el año, ya por bastantes años, se escucha hablar de la existencia de un dinero que EEUU dedica a proyectos relacionados con Cuba. Una suma de dos, tres, varias decenas de millones de dólares que indistintamente se puede bautizar como fondos para promover la libertad y la democracia en Cuba, o fondos para apoyar o “crear” una contrarrevolución. No son pocos los opositores y disidentes dentro de la isla que creen que ese dinero existe por y para ellos, por lo que ven su adjudicación a organizaciones del exilio-emigración como un error o en el peor de los casos como un despojo. Otros compatriotas, sobre todo exiliados-emigrados no en EEUU, lo perciben como un dinero que por solidaridad y hasta obligación estaría colgado en el presupuesto federal, y cuyo gasto no ha terminado en el derrocamiento de la dictadura castrista simplemente porque no se ha invertido de manera adecuada; es decir, no se ha entregado a las organizaciones, personalidades o celebridades anticastristas correctas. A ellos mismos.
Dejando aparte por el momento otras cuestiones importantes, reconozcamos que ese dinero para proyectos relacionados con Cuba efectivamente existe en EEUU y lo suelen distribuir agencias e instituciones del gobierno. Pero no se trata de un premio o una lotería, es algo que hay que “jocear” o “luchar” en competencia con otras organizaciones y personalidades anticastristas pretendientes. Los castristas-revolucionarios no participan en este tipo de emulación. Para ganar parte de ese dinero hay que tener buenas relaciones, estar bien asesorado por abogados y especialistas (hay expertos en conseguir “grants” a quienes por supuesto debe pagarse una parte del dinero ganado), y también escribir un convincente proyecto que (al menos formalmente) persuada a la entidad “donante” de la importancia y viabilidad de lo que usted pretende hacer con ese dinero en relación con Cuba; ya sea fuera o dentro de la isla. Hay que decir que el control sobre este tipo de dinero, y la presión de la prensa y la legislación norteamericana es cada día mayor. Además menos cuantiosa la cantidad a repartir y creciente el número de aspirantes.
En este negocio el contratista Alan Gross era un solicitante de lujo, inteligente y hábil. Gross tenía gran experiencia en el  trabajo global, por lo que era normal que su pericia fuera bien pagada. Alan Gross consiguió financiamiento de la DAI para llevar a cabo proyectos en Cuba, en dinámica parecida a la permitió a la DAI conseguirlo de la USAID. En sentido estricto la DAI no otorga el financiamiento a Alan Gross sino a la Joint Business Development Center (JBDC); lo que finalmente es casi lo mismo porque era su propia compañía.

Must-Read: U.N. Says Castro's Judiciary is a Farce

The U.N. Working Group on Arbitrary Detention has called for the Castro regime's release of American development worker Alan Gross.

Its opinion on the case is a must-read on two grounds:

First, it notes how the Castro regime's judiciary lacks any independence or impartiality.

Second, it holds that Castro's infamous "Law Against the Sovereignty and Territorial Integrity of the State," which is used to unjustly imprison peaceful dissidents, is contrary to Article 11 of the Universal Declaration of Human Rights.

Let's hope this gives some pause to those who advocate for the recognition and respect of Castro's absurd laws, including those who advocate for the elimination of USAID's democracy programs.

According to the U.N.'s Working Group:

43. [I]t is within the Working Group’s competence to analyze if the person had the right to fair and impartial legal proceedings before an independent court. The detention would be arbitrary if the court had rejected exculpatory evidence or admitted illegal evidence.

44. In order to begin its analysis as to whether the present case is situated within the framework of Category III utilized by the Working Group, the Group had to first take note that neither the Government nor the source dispute that Mr. Gross was able to enjoy many of his procedural rights, such as presenting evidence; cross-examining the witnesses for the prosecution; presenting his own defense witnesses; having legal counsel of his choosing; having had a period of time to prepare his defense; having had interpreters; declaring freely; as well as the fact that the trial was public and attended by observers from his country, family members, and friends of the accused, among others.

45. In addition, the Working Group notes that there are no differences in some of the objective facts in the case. Both the source as well as the Government accept that Mr. Gross was in Cuba for the purpose of working on a project named “Para la Isla” [“For the Island”] of an agency of the Government of the United States of America; that he acted under a contract of the firm Development Alternatives, Inc. to carry out a project jointly with USAID; that the bringing in of equipment for facilitating wireless connections to the Internet was legal; that Mr. Gross made five trips to Cuba as a tourist, always using his United States passport; and that he maintained relationships with Jewish communities in Cuba; among others.

46. However, there are serious differences between the parties with regard to the following points: firstly, as to whether the courts that tried Mr. Gross in the first and second instances were or were not independent and impartial.

47. In order to resolve this issue with the greatest possible degree of impartiality, the Working Group recalls the following:

(a) In 2000, the Special Rapporteur on Violence against Women observed with concern that the National Assembly of People’s Power has the authority to appoint and dismiss the People’s Supreme Tribunal and the Attorney General and his/her substitutes; the Office of the Attorney General is subordinate to the National Assembly and to the Council of State; and the Attorney General is accountable for the performance of his/her duties to the National Assembly. Said constitutional provisions hinder the impartiality and independence of the judiciary (E/CN.2000/131, paragraph 67). The Government of Cuba, emphasizing that the people have chosen a socialist political system, rejected this assertion, which in its view was based on false information that had been fabricated by malicious sources or was based on fundamentalist ideological positions (E/CN.4/2000/131, p. 9).

(b) The Committee against Torture had recommended in 1997 that the rules for organizing the judicial system be adjusted so as to accord with international standards (A/53/44, paragraph 118).

(c) In 2007, the then-Special Rapporteur on the Independence of Judges and Lawyers reminded Cuba that, in accordance with international standards, military courts in principle should not have jurisdiction to try civilians (A/53/44, paragraph 118).

(d) The former Personal Representative of the High Commissioner for Human Rights recommended that Cuba adjust its criminal procedure to the provisions of Articles 10 and 11 of the Universal Declaration of Human Rights (A/HRC/4/12, paragraph 35; E/CN.4/2006/33, paragraph 35; E/CN.4/2005/33, paragraph 36); [sic] E/CN.4/2004/32, paragraph 35).

(e) According to the Special Rapporteur on the Right to Food, access to justice with regard to the right to food should be improved. The courts should have a mandate to examine human rights violations and an independent institution should be established and charged with processing complaints and providing reparations for infractions committed (A/HRC/7/5/Add.3, paragraph 79 (c)). In response to this communication, the Government of Cuba clarified that its inter-institutional system processes said complaints (A/HRC/8/4/Add.1, paragraphs 108-110).

48. The aforementioned antecedents, emanating from reports from the non-conventional mechanisms created by both the former Commission as well as the current Human Rights Council, were compiled by the Office of the High Commissioner for Human Rights for the Working Group in charge of the Universal Periodic Review of Cuba (see document A/HRC/WG.6/4/CUB/2 dated December 18, 2008, paragraph 20). Said reports were considered in due course by the organs which established said mechanisms with no reservations or objections whatsoever. Consequently, the Working Group cannot ignore same.

49. By virtue of said antecedents, the Working Group cannot rule out the fact that the courts of first and second instance that tried Mr. Gross did not exercise the judicial function in an independent or impartial fashion.

50. The Working Group must also consider if the national security law – and specifically its Article 91 – fulfills the requirements of precision and certainty that authorize the application of a sentence. Illicit conduct, in accordance with criminal doctrine, must be perfectly described prior to the commission of the illicit act, in harmony with the provisions of Article 11 of the Universal Declaration of Human Rights. But that description must be precise, such that the potential criminal knows the limits between what is and is not considered criminal activity. The classification of a crime must contain all of the necessary elements for this.

51. In the opinion of the Working Group, the description of the punishable offense in Article 91 of the Criminal Code of Cuba does not fulfill the requirements of precision required for the criminal to know exactly what conduct is prohibited. In effect, said article, inserted among acts against the independence or territorial integrity of the State, within the section related to crimes against State security, provides that “the one who, in the interests of a foreign State, executes an act with the purpose of harming the independence of the Cuban State or the integrity of its territory, shall incur in a sanction of imprisonment of 10 to 20 years or death.” The vagueness of concepts such as “executing an act”; “in the interests of a foreign State”; [and] “harming the independence of the Cuban State or the integrity of its territory” do not satisfy the requirement of a rigorous description of punishable conduct.

In conclusion, the Working Group considers that the courts of first and second instance that tried Mr. Gross did not exercise their function in an independent or impartial manner. Article 91 of the Criminal Code does not satisfy the requirement of rigorous description of  punishable conduct, which lends an arbitrary nature to the detention.

U.N. Imprisonment Watchdog Calls on Cuba to Release Alan Gross

WASHINGTON (Jewish Telegraphic Agency) -- The United Nations Human Rights Council's imprisonment watchdog called on Cuba to release jailed Jewish-American contractor Alan Gross.
The Human Rights Council's Working Group on Arbitrary Detention said in an opinion released Tuesday to Gross' lawyer that Cuba's lack of an independent judiciary, the imprecise nature of the alleged crime and the failure to grant bail to Gross rendered his 15-year sentence "arbitrary."
The opinion does not consider the charges against Gross, who delivered computer and Internet equipment to the island's tiny Jewish community, saying they are out of its purview. The opinion also rejects complaints by Gross' lawyer, Jared Genser, that Gross was denied due process and that the charges violate speech freedoms.
However, it notes from its previous considerations of Cuban cases that the country's judicial system serves at the whim of the country's one-party system. It also says the vagueness of the section of the criminal code under which Gross was convicted "does not satisfy the requirement of a rigorous description of punishable conduct." The opinion also faults the courts for not releasing Gross on bail for 14 months. "By virtue of what has been set out, the Working Group asks the Government of Cuba to immediately release Mr. Alan Phillip Gross," the 12-page opinion concludes. The working group is made up of experts from Chile, Norway, Pakistan, Senegal, and Ukraine.
Cuba is not a party to the International Covenant on Civil and Political Rights, and in a news conference last month; a top Cuba official alluded to the report and suggested that Cuba would not heed its recommendation. In its response to the charges, attached to the working group's opinion, Cuba said its judiciary functions as independent within a socialist system.
Gross' wife, Judith, cited the opinion in her latest appeal Tuesday to Cuban President Raul Castro to release Gross. "Given this ruling, I would like to know why your government is ignoring the declaration of the United Nations that his imprisonment to be wrongful and its request for Alan’s immediate release?" she asked Castro. She also noted Gross' poor health -- he has lost 100 pounds since his arrest in December 2009 -- and again requested an independent medical examination. She repeated a request that Castro allow Gross to visit his ailing mother, who is 90 and has cancer, as well as his family. One of Gross' daughters is a cancer survivor and the other recently survived a car accident.
Judith Gross concluded her appeal by "praising" Cuba's request for dialogue with the U.S. government on the matter, an allusion to Cuban suggestions that Gross could be exchanged for convicted spies known as the Cuban Five.

This is my first ever letter to an American president. That’s not just because I’m not an American citizen. I’m also a journalist, and journalists are not in the habit of writing letters to heads of governments.
But having spent the past three years researching the case of the Cuban Five, I believe I have an obligation to write to you.
The fact is American journalism hasn’t done a very good job of explaining to the American public the case of the five Cuban intelligence agents who have been incarcerated in the U.S. since 1998. As a result, your administration has mostly managed to avoid dealing with the issue at all or, when forced to comment, responding with the tired, rote rhetoric of the Cold War era.
But the case of the Cuban Five has recently been brought back into the public spotlight because of Alan Gross, the USAID subcontractor currently serving a 15-year jail term in Cuba for bringing satellite communication equipment into that country.
The media reporting of his case has been equally problematic, mostly parroting your own State Department line that Gross is a “humanitarian” who was arrested while trying to help Havana’s tiny Jewish community communicate with the outside world, and is now being held “hostage” by Havana.
You know that’s not true. So, of course, should the media. After all, it was Desmond Butler, a foreign affairs reporter for the Associated Press—a news agency subscribed to by most American media and unlikely ever to be mistaken for a tool of the Cuban regime—who documented the facts of the case.
Alan Gross was “paid a half-million dollars” by USAID, your government’s “democracy promoting” agency, to smuggle sophisticated communications equipment into Cuba. That technology included Internet satellite phones capable of avoiding detection and spy-quality SIM cards “most frequently” used by the Defense Department and the CIA.
The goal of all of this was not to assist Cuba’s Jewish community communicate, as your government has insisted (the Jewish community already had Internet connectivity) but to promote regime change—to overthrow the government of Cuba.
Gross’s own reports make clear he knew he was engaged in “very risky business” and that discovery of what he was up to “will be catastrophic.”
That said, Alan Gross’s family and friends, not surprisingly, want him freed.
Just as the Cubans want the Five—who are considered national heroes in their homeland—freed.
Your government’s unblinking response has been that there is simply “no equivalence.” The Cubans were trained intelligence agents convicted of trying to steal military secrets and conspiracy to murder four innocent civilians killed in the shootdown of two unarmed Brothers to the Rescue aircraft in 1996. By contrast, the American argument goes, Alan Gross was just a humanitarian do-gooder.
We now know Alan Gross was much more than that.

'Foreign Affairs': John Kerry se reunió con Bruno Rodríguez para negociar la liberación de Gross

El senador demócrata John Kerry, quien podría ser el próximo secretario de Estado norteamericano, sostuvo en 2010 una reunión secreta con el ministro cubano de Relaciones Exteriores, Bruno Rodríguez, en un fallido intento de obtener la liberación del estadounidense Alan Gross, condenado en Cuba a 15 años de cárcel, informó la revista Foreign Affairs.
Según Foreign Affairs, ese mismo año el entonces subsecretario de Estado Arturo Valenzuela también se reunió con Rodríguez y recibió un sermón del ministro.
Gross fue arrestado en La Habana en diciembre de 2009. Las autoridades cubanas lo acusaron de distribuir equipos prohibidos de comunicación en la Isla, como parte de los "programas pro democracia" de la Agencia de Estados Unidos para el Desarrollo Internacional (USAID), a la que el Gobierno cubano acusa de intentar provocar un "cambio de régimen".
El artículo en Foreign Affairs está firmado por R.M. Schneiderman, un editor de Newsweek, quien afirma que en septiembre del 2010, funcionarios españoles ayudaron a concertar el encuentro secreto entre el Valenzuela y Rodríguez para discutir una posible liberación de Gross, informa el diario miamense El Nuevo Herald.
"Los cubanos fueron mucho menos flexibles de lo que esperaban los estadounidenses. Estados Unidos (…) quería que Cuba liberara a Gross, y solo entonces trataría otros cambios de política", escribió Schneiderman. "Supuestamente Rodríguez sermoneó a Valenzuela por casi una hora sobre la historia de reclamaciones de Cuba".
Un mes después, a solicitud de diplomáticos cubanos en Washington y con la aprobación del Departamento de Estado, Kerry se reunió con Rodríguez en la casa en Nueva York del embajador cubano en las Naciones Unidas, agregó el periodista.
Según Schneiderman, "no hubo un intercambio de posiciones, pero la reunión pareció confirmar a los cubanos que los programas pro democracia cambiarían, y los cubanos expresaron confianza" en que Gross sería liberado después de su juicio, que se celebró en marzo de 2011.
El presidente Barack Obama ha nominado a Kerry, un demócrata por Massachusetts, para sustituir a Hillary Clinton al frente del Departamento de Estado. Se espera que la Comisión de Relaciones Exteriores del Senado, que preside Kerry, apruebe fácilmente su nominación.
El senador ha sido un duro crítico de los programas de ayuda a la democracia en Cuba y de Radio y TV Martí.
Schneiderman dijo además en su artículo que, a comienzos del 2010, el Departamento de Estado y la USAID recurrieron a Fulton Armstrong, un alto empleado de la Comisión de Relaciones Exteriores del Senado, ex analista de la CIA y también crítico de los proyectos de la agencia estadounidense.
A Armstrong se le habría pedido que ayudara a hacer menos provocadores los programas dirigidos a Cuba, con la esperanza de que La Habana accediera a liberar a Gross.
El funcionario habría persuadido al Departamento de Estado y la USAID para recortar de inmediato 5 millones de dólares de los 20 millones aprobados para los programas hacia Cuba, y para continuar reduciéndolos en el futuro, indicó Schneiderman.
En el verano de 2010 y "a petición del Departamento de Estado", Armstrong comenzó a reunirse con funcionarios de la misión diplomática cubana en Washington para hablarles sobre los cambios en los programas, añadió.
Los cubanos parecieron agradecidos. "Les preguntamos: '¿Esto los ayudará a liberar a Alan Gross?'. Y la respuesta fue: 'sí'", dijo Armstrong, según citó Schneiderman.
El periodista dijo que el senador cubanoamericano Bob Menéndez, demócrata por Nueva Jersey, salió en defensa de los programas hacia Cuba en la primavera de 2011 y persuadió a la Casa Blanca de dar marcha atrás a la mayoría de los cambios.
A esto se unieron presiones domésticas dentro de la Isla por las reformas económicas del régimen y la decisión de un jurado estadounidense de declarar no culpable a Luis Posada Carriles, tras un juicio en el que fue acusado de mentir a funcionarios de inmigración de Estados Unidos.
"Esperemos que este fiasco encabezado por Fulton Armstrong ponga fin a más intentos de apaciguamiento", dijo sobre el artículo de Schneiderman el ex alto funcionario de la USAID José Cárdenas, citado por El Nuevo Herald.
Sin embargo, un alto ayudante de los republicanos en el Senado contradijo el reporte de Schneiderman sobre el papel desempeñado por Armstrong.
"Mis conversaciones con el Departamento de Estado revelaron lo contrario, que el Departamento de Estado estaba molesto con Fulton, que quería que no se metiera en el asunto", dijo el asistente, quien pidió mantenerse el anonimato porque no estaba autorizado a dar declaraciones sobre el tema, según el diario miamense.
"Sus esfuerzos en realidad hicieron (…) más difícil para el Departamento de Estado lograr la liberación de Gross, porque Fulton estableció expectativas (...) que los cubanos se creyeron y que eran políticamente imposibles en Estados Unidos", agregó.
La Habana ha sugerido en varias ocasiones un canje de Gross por los cinco agentes cubanos que cumplen condena en Estados Unidos por espionaje. Hasta ahora, Washington ha dicho que ese intercambio no ocurrirá.
No obstante, Schneiderman escribió en su artículo que muchos consideran "negociable" la oferta cubana.

Hunger Striker Demands Immediate Release of Alan Gross & Eduardo Arocena

Alan Phillip Gross is an American international development expert who was working in Cuba as a U.S. government subcontractor for the U.S. Agency for International Development (USAID) when he was arrested and ultimately convicted for acts against the independence or the territorial integrity of the state.
He was prosecuted in 2011 after being accused of crimes against the Cuban state. Gross alleges he was bringing satellite phones and computer equipment to members of Cuba's Jewish community. It was claimed Gross's objective involved setting up Cuban dissidents with satellite communication systems that would work through satellite phones and laptops. He is serving a 15-year prison sentence in Cuba.
Eduardo Arocena was convicted of serious crimes against federal laws of the United States through the use of violence, including the assassination of Cuban diplomat Felix Garcia Rodriguez. However, nearly thirty years in prison met by Eduardo Arocena, according to international standards of detention, including Cuba, are considered sufficient for the release of a convict. Since 1959, Cuba has imprisoned many of the anti-Castro fighters for acts considered by Cuba as terrorists with actions that caused death of civilians. Virtually all those convicted has been freed by Cuba after serving a prison term shorter than the one served by Eduardo Arocena.
The U.S. government should take into consideration the long prison terms served by Eduardo Arocena and order his release immediate.
Cuba's government should order the immediate release of Alan Gross for reunification with his wife, daughters and other family, while restoring his health problems.
The circumstances of the contemporary world should prevail in both governments, both of Washington such as Havana, and help alleviate the suffering of the prisoners and their families.
Gualdo Hidalgo, former Cuban political prisoner and Latin Heritage Foundation publisher, will keep the hunger strike until both governments agree to release Eduardo Arocena y Alan Gross.

Gross Accepted Project in Cuba Without Knowing Risks, Lawyer Says

WASHINGTON – The U.S. subcontractor Alan Gross, a prisoner in Cuban since 2009, was no James Bond, just someone who undertook a project without knowing what the risks were, but convinced that if any problems should arise, the United States and the company that contracted him would come to his aid, his lawyer, Scott Gilbert, told Efe.
Now 63, Gross was detained in Havana three years ago in possession of satellite communications equipment he was planning to distribute among Cuba’s Jewish community under a contract with a firm hired by the U.S. Agency for International Development.
Gross and his wife Judy filed a $60 million lawsuit last month against USAID and contractor DAI for allegedly failing to inform Alan of the risks associated with the mission or provide him with protection.
“The State Department has said publicly in the press that they knew that Alan was being sent to Cuba with devices that were illegal in Cuba ... how can the U.S. government send a civilian to Cuba knowing that?” Gilbert said during an extensive interview at the offices of his Washington law firm.
Havana says Gross was illegally aiding dissidents and inciting subversion on the Communist-ruled island. Last August, Cuba’s highest court upheld the 15-year jail sentence imposed on the American five months earlier.
U.S. officials and the Gross family demand his unconditional release, insisting that Gross did nothing wrong and is a humanitarian worker dedicated to Jewish causes.
Gross made five trips in 2009 – he was arrested during the last one on Dec. 3 – and according to the lawsuit, in his reports on the third and fourth trips he had started sounding the alarm about what a high-risk mission this was.
“I can tell you categorically that Alan Gross did not expect to be apprehended or detained in Cuba or spend one night in custody,” Gilbert said. “For Alan, it’s been a Kafka-like experience every step of the way.”
“When Alan raised concerns about the trips they essentially said to him either you finish this project or we’ll find somebody else to do it,” the Gross family attorney said.
“Alan believed they (USAID) were looking out for him and that they would never let him get into a situation where direct harm would come to him,” Gilbert added.
“I believe that Alan is a very idealistic individual, idealistic to the point of being even potentially somewhat naive,” the lawyer said, insisting that “USAID and DAI never should have approved this project in the first place.”
“They violated their duties to Alan (and) their own rules,” Gilbert said of the defendants in the suit.
In parallel to the lawsuit, another Gross attorney, Jared Genser, is collaborating with public relations efforts and a campaign to pressure the U.S. and Cuba to sit down and negotiate a solution.
The Gross family is asking President Barack Obama to designate a special envoy with full authority to negotiate with Cuba. EFE

Resolution introduced on 3rd Anniversary of Alan Gross’ arrest in Havana

WASHINGTON, D.C. – U.S. Senators Ben Cardin (D-Md.) and Jerry Moran (R-Kan.) have introduced a resolution calling on Cuba to immediately and unconditionally release Marylander Alan Gross. The resolution, introduced on the 3rd Anniversary of Mr. Gross’ arrest in Havana, Cuba, is co-sponsored by 29 of their Senate colleagues including Barbara Mikulski (D-Md.). It also urges the Cuban government to address Mr. Gross’ medical issues. When passed, it will mark the first time Congress has taken the step of passing a resolution condemning Mr. Gross’ arrest and calling for his release. Sens. Cardin, Moran and Mikulski held a joint press conference with Judy Gross, the wife of Alan Gross, this morning to discuss the resolution.

“Year after year, the Cuban Government continues to demonstrate why bilateral relations between our two countries remain frozen,” Sen. Cardin said. “Alan Gross should no longer be forced to suffer the consequences of political gamesmanship. Enough is enough. Alan should be immediately and unconditionally released so he can return home for medical treatment and to support his family. The health and humanitarian needs of he and his family are paramount,”

“The Senate’s passage of this resolution will send a loud and clear message to Cuba: it is past time for Alan Gross to come home,” Sen. Moran said. “For more than a decade, I have worked to open Cuban markets to American agriculture. This year, however, I stepped back from these efforts because the Cuban government has a responsibility to cooperate with the United States on the unjust detention of Alan Gross. The path to improved America-Cuba relations has always been difficult, but it is that much more difficult and unlikely until Cuba releases Alan Gross.”

“It’s long past time Alan Gross be immediately and unconditionally released from his imprisonment in Cuba,” Sen. Mikulski said. “For three years he and his family have suffered from these bogus charges and a sham trial. And for three years the Cuban government has ignored basic human rights and has shown they are not serious about building a relationship with the United States. I want Alan and Judy Gross to know that they are not in this fight alone. I will continue to do all I can so Alan can come home to Maryland and his family.”

Alan Gross was arrested on December 3, 2009, and after a two-day trial, was given a 15-year prison sentence by Cuban authorities for facilitating communications between Cuba’s Jewish community and the rest of the world. Mr. Gross was in Cuba working as a sub-contractor for the United States Agency for International Development, helping a small, peaceful, non-dissident community. He was doing the type of work he had done his whole career in international development – helping others in need.

A 63-year-old husband and father, Mr. Gross has lost more than 100 pounds since his arrest and suffers from severe degenerative arthritis that affects his mobility, as well as other health problems. The Cuban Government has denied requests by Mr. Gross for an independent medical examination by a doctor of his choosing. Members of his family have also faced serious illnesses during this time.

Castro Admits Alan Gross is a Hostage

The Castro regime has replied to a letter by over 40 U.S. Senators asking for the humanitarian release of American development worker, Alan Gross, held in a Cuban prison since December 2009.

In its response, the head of the Cuban Interests Section in Washington, D.C., Jose Ramon Cabanas, states:
To demand from and hope for the Cuban Government to take the unilateral decision of releasing Mr. Gross without giving any consideration whatsoever to the legitimate concerns of our country is not a realistic approach... 
And what are the regime's "legitimate" concerns?
...[E]nclosed is a summary information on the case of the Five Cubans who remain unjustly imprisoned or retained in the United States, in respect of whom Cuba has legitimate humanitarian concerns.
Alan Gross is the person seized or held as security.

The so-called Cuban Five are the condition for his release.

That is a hostage-taking.

December 3rd, three days from now, marks the three year anniversary of Alan's wrongful imprisonment in Cuba. December 3rd, 2009 is when Alan was arrested in Cuba. He was then held in prison for 14 months without charges and then later convicted for undermining the sovereignty and territorial integrity of Cuba. Cuba Hoping to Benefit From Possible Gross Release

Gen. Raúl Castro’s regime is considering a pardon for Alan Gross, the American USAID subcontractor arrested in Cuba in December 2009 and sentenced to 15 years in jail for distributing computers to the Jewish community in the island. This calculated olive branch to the just-reelected Obama administration has two objectives. First, to obtain U.S. concessions in the area of travel by U.S. citizens to Cuba. Second, to obtain the release of four Cuban spies, serving sentences in U.S. jails for espionage activities on behalf of the Castro government.
Some within the Castro regime are arguing that the Obama administration will be pushed to offer major concessions if Cuba frees Gross. The reasons: there is a pent-up demand for travel to Cuba; American tourists will bring much needed dollars; and Cuba’s efficient security apparatus could control American tourists, primarily interested in visiting Cuban beaches and less concerned about subverting the Communist regime.
Most argue that American tourists will have little impact, other than economic. They point out that over the past several years hundreds of thousands of Canadian, Europeans and Latin American tourists have visited the island. There have been no major political changes. Money from tourists, furthermore, has been flowing into businesses owned by the Castro government and the Cuban military, thus strengthening state enterprises.
The recent migration law enacted by Cuba that eases travel for Cubans to visit the United States and other countries is also entering into Gen. Castro’s calculations. The liberalization of Cuban travel will put pressure on the Obama administration to allow Americans to travel to the island. From Cuba’s point of view it is a win/win situation. More Cubans will travel abroad, many staying in the host country or making their way to the U.S. More American tourists will travel to Cuba leaving their dollars in the island.
What should the United States do? Any major policy concession to Cuba will be out of proportion to the release of an unjustly imprisoned American. Gross is a hostage being used by the Cuban government to exact change from the U.S. The history of U.S-Cuba relations has been characterized by Cuba’s daring actions followed by major U.S. concessions (i.e. U.S.-Cuba migration accord allowing 20,000 Cubans to enter the United States following Mariel). The release of Gross should be seen as a humanitarian gesture requiring no action on the part of the United States. When Raúl Castro is willing to offer irreversible concessions, the administration should respond in kind. Ping-pong diplomacy worked with China. Tit for tat should with Cuba.
