Contra la reconciliación incondicional entre Cuba y EEUU

Un grupo de prominentes ciudadanos norteamericanos —entre los que se encuentran varios notables empresarios de origen cubano—, le ha escrito una carta pública al presidente Barack Obama solicitándole que suavice las medidas encaminadas a agravar la difícil situación económica de la dictadura comunista de los hermanos Castro.

La carta no es el resultado de una oscura maniobra de La Habana, aunque el régimen y sus servicios de inteligencia la vean con deleite porque coincide con sus intereses, sino la consecuencia de una indiscutible verdad: nadie sabe cómo acelerar desde fuera el fin de una dictadura como la cubana o la de Corea del Norte. Sus autores están convencidos de que la antigua estrategia norteamericana está equivocada.

Es un viejo debate. Quienes redactaron la carta —presumiblemente los empresarios cubanoamericanos— piensan que la estrategia de abrazar al enemigo e intentar fortalecer a la sociedad civil redundará en el debilitamiento de la tiranía.

¿Logrará su propósito esa carta? No lo creo. No debiera por las siguientes siete razones:

1. La incoherencia tiene sus límites, más allá de los cuales hay que hablar de esquizofrenia. Washington acaba de declarar oficialmente que el Gobierno cubano es terrorista y Raúl Castro le ha dado la razón enviándole a Corea del Norte armas de guerra camufladas bajo toneladas de sacos de azúcar. ¿Por qué abrazar a un régimen terrorista cuando se aprueban sanciones contra Rusia o Venezuela por comportamientos antidemocráticos?
2. En el momento en que se divulgaba la carta de marras, el coronel Alejandro Castro Espín, hijo del dictador Raúl Castro, firmaba un acuerdo de cooperación en Moscú con los servicios de inteligencia de Putin. Luego pasó por La Habana el Jefe del Estado Mayor del ejército chino, presumiblemente a formalizar una gestión parecida. En el pasado, Fidel Castro, en Teherán, había advertido que todos juntos podían poner de rodillas al enemigo imperialista.
3. Según afirma Raúl Castro, una y otra vez, y reiteran sus más altos funcionarios, las "reformas" económicas,tienen como fin perfeccionar la dictadura comunista de partido único. ¿Por qué Estados Unidos debe cooperar con una vieja y fallida tiranía que intenta superar las dificultades y consolidarse en su peor momento económico y psicológico, cuando toda la estructura de poder en la Isla sabe que el marxismo-leninismo es un fracaso?
4. El régimen cubano es un enemigo tenaz y permanente de Estados Unidos. Sus líderes están convencidos de que todo lo malo que sucede en el planeta es culpa de Washington. No se cansan de decirlo. En el pasado, La Habana pactó con la URSS y hasta pidió el bombardeo atómico preventivo durante la Crisis de los Misiles. Hoy Cuba se pone de acuerdo con Irán, Corea del Norte, Rusia y los países del llamado Socialismo del Siglo XXI para perjudicar a sus vecinos. ¿Tiene sentido un trato benevolente con semejante gobierno? 
5. Existe, también, el ángulo ético. Durante todo el siglo XX, con razón, Estados Unidos fue acusado de indiferencia moral por el buen trato que le daba a dictaduras como la de Trujillo, los Somoza, Batista o Stroessner. Ahora está en el lado correcto de la historia. En Cuba se violan los derechos humanos brutalmente. El año pasado se duplicaron las detenciones a los disidentes. Los cubanos no tienen acceso a Internet. A las tres horas de haber aparecido 14ymedio, el diario digital de Yoani Sánchez, bloquearon la señal dentro de Cuba. Estados Unidos no debe volver a la indiferencia moral que tanto afectó la buena imagen del país.
6. Hay que tomar en cuenta la razón electoral. La Casa Blanca debe escuchar a los legisladores cubanoamericanos y no necesariamente a los empresarios. De alguna manera, expresan el sentir mayoritario de los cubanos radicados en EEUU. El importante senador demócrata Bob Menéndez, los senadores republicanos Marco Rubio y Ted Cruz, los congresistas demócratas Albio Sires y Joe García, y los congresistas republicanos Ileana Ros y Mario Díaz Balart, discrepan en muchas cosas, pero están de acuerdo en mantener una política de firmeza frente a la dictadura.
7. El objetivo de Estados Unidos debe ser que en Cuba se instaure una democracia plural y próspera que deje de expulsar a sus ciudadanos hacia el vecino del norte, con la cual desarrollar unas relaciones respetuosas y normales. El sentido común indica que eso no se logra ayudando a la tiranía de Raúl Castro en medio de una crisis.

Y tres razones cubanas para oponerse a la reconciliación incondicional de EEUU y Cuba:

1. A los cubanos demócratas no les interesa ni conviene que la dictadura de los Castro se salte a la oposición y entable una negociación política con Estados Unidos. El problema esencial de Cuba no es la rivalidad entre los dos gobiernos, sino el hecho de que en la Isla existe una dictadura de partido único de corte estalinista que no escucha a la sociedad. Las transiciones comienzan cuando el poder reconoce la existencia de opositores legítimos. El paso previo a la reconciliación EEUU-Cuba debe ser la admisión de que en la Isla existen unos cubanos que tienen derecho a opinar sobre el destino del país.
2. La reconciliación incondicional entre EEUU y Cuba envía una poderosa señal internacional que confirma que la dictadura de Raúl Castro es un gobierno normal con el que se debe y puede establecer cualquier tipo de vínculo. Tras la normalización de los lazos entre los dos países vendrán diversos tipos de ayudas y subsidios económicos impulsados por intereses que carecen de resortes morales. Esto reforzará la permanencia de la dinastía militar en el poder.
3. Esa cordial entente entre los dos países dejaría aún más solos a los disidentes, presos políticos y, en general, a los demócratas de la oposición que desean y buscan un cambio político pacífico, pero real. Lo verían como una traición a los ideales de la libertad y el respeto por los Derechos Humanos que Estados Unidos dice defender. Es esencial que la dictadura ratifique oficialmente el compromiso de respeto a los Derechos Humanos que en el 2007 hizo con la ONU el entonces canciller Felipe Pérez Roque. Entonces se comprometió a que el Gobierno cubano suscribiría el Pacto Internacional de Derechos Económicos, Sociales y Culturales y el Pacto Internacional de Derechos Civiles y Políticos aprobado en 1976 por Naciones Unidas. Sería una débil señal de rectificación, pero por algo se comienza. En todo caso, hasta que la disidencia democrática no dé su visto bueno, Washington no debe moverse. Es lo que les conviene a los norteamericanos y a los cubanos.

Cuarenta personalidades cubanas y norteamericanas han hecho un llamado al presidente Barack Obama para que suavice el embargo a Cuba. La iniciativa tiene una notable excepcionalidad histórica. Universalmente, los opositores a las dictaduras piden a Washington que exija a los opresores el restablecimiento del Estado de derecho o, en caso mínimo, que suavicen la represión. Carlos Saladrigas, el Cuba Study Group y los firmantes de la petición apuestan, sin embargo, por la inversión y la supresión parcial o completa del  embargo en aras de una hipotética construcción (¿en tres, quince años?) de la sociedad civil.

No debemos pensar en la asfixia de la dictadura más larga, destructora y expansionista que hayan visto las Américas. En rigor, el solo reclamo a un incondicional e inmediato retorno a la democracia y el enjuiciamiento de los principales actores totalitarios es criminalizado como una invitación al baño de sangre. So pena de ser considerado anacrónico, contraproducente y, en suma, antipatriótico, el discurso ha de inhibirse de los más elementales principios.

Máscara de más, máscara de menos, este gesto no apunta a la supresión del embargo, sino a consolidar económicamente a Raúl y su mafia vasalla antes de la supresión del embargo. Al pueblo llano, el comercio de empanadas, la reparación de aires acondicionados y el divino arte de la peluquería. A la elite, los grandes negocios que configuran la superestructura económica de un país. Cheo con el paladar de la esquina. Raúl y los suyos con el puerto del Mariel.

La idea de introducirle a Raúl el Caballo de Troya de una sociedad civil económicamente independiente, en estrecha conexión con Estados Unidos, ofende al sentido común. Aún así, el debido respeto a las inteligencias de Saladrigas, sus asociados y sus defensores consigue trasladar esta petición a Obama desde el terreno de las patológicas estupideces al terreno de los repugnantes y fraudulentos enigmas.

En este tránsito del castrismo sin mercado al castrismo con mercado se alista todo un ejército de intelectuales, blogueros, académicos, curas, empresarios y mucha, mucha gente de prensa. Saladrigas y el Cuba Study Group cabalgan a la vanguardia. Ahí están sus declaraciones y sus hechos. La propuesta de salvar a Cuba concediéndole a la dictadura una patente de perpetuidad y enriquecimiento marca un degradante hito.

Cierto que el desarrollo económico genera democracia. Pero solo allí donde existe un Estado de derecho. A pesar de las sanciones de medio mundo, Irán disfruta de un mercado pujante, con sectores de tecnología y servicios sumamente competitivos. El auge del nivel de riqueza en Vietnam y China no impide que la pena de muerte ajuste de manera cíclica el espacio del pensamiento no oficial.

Notemos además que a las antiguas naciones comunistas de Europa del Este no las liberó el comercio minorista, ni siquiera la sola acción de los sindicatos independientes y los disidentes, sino la promesa de Gorbachov de mantener en sus cuarteles a las ocupadoras divisiones de tanques del Ejército Rojo.

Por último, ¿la proliferación de paladares ha fortalecido a la disidencia? ¿El incremento de vendedores de figuras de yeso logró contener la represión? ¿Conspiran contra Raúl los amoladores de tijeras? ¿Protestaron los forradores de botones por el asesinato de Oswaldo Payá? ¿El millonario Silvio Rodríguez compone canciones para las Damas de Blanco? ¿Los millones de Ramiro Valdés sostienen a un sector aperturista?

Saladrigas se pregunta qué de malo pueda haber en que un cubano de acá invierta en la incipiente empresa de un cubano de allá. Nada, por supuesto. La aberración consiste en pedirle la solución a Obama y no a Raúl. Basta con restaurar las plenas libertades civiles y económicas para todos los cubanos. Con eso desaparece la ley Helms-Burton, que determina el embargo. Extraña que mentes tan ágiles malinterpreten dilemas tan simples.  

En el sórdido rompecabezas de Cuba han encajado nuevas piezas. Si Obama le concede este deseo a Raúl veremos el establecimiento de jugosos negocios de líderes, herederos y agentes económicos del castrismo situados en las dos orillas, en conjunción con capitales cubanoamericanos y norteamericanos. Imposible saber si Saladrigas y sus asociados van a ganar algo. Salta a la vista todo lo que han perdido.

What the U.S. Chamber Won't Tell You About Cuba

In announcing his upcoming trip to Cuba, U.S. Chamber of Commerce President Tom Donohue stated:

“Since I was last in Cuba 15 years ago, a reform program has reportedly taken 600,000 workers from government payrolls and allowed the number of self-employed entrepreneurs in the country to triple to more than 450,000."

Sort of.

According to the Castro regime's official statistics, 600,000 workers have supposedly been removed from government payrolls, though well-short of its announced goal of 1 million layoffs by the end of 2011. A major concern is that very few of the laid-off workers have transferred to the "self-employment" sector.

Then, the fuzzy math begins.

The number of "self-employed entrepreneurs" has not tripled to more than 450,000.  During Donohue's 1999 trip to Cuba there were nearly 210,000 self-employed licensees. Thus, according to the Castro regime's official, unverified statistics, in the last 15 years there has been a net gain of 240,000 new licensees. That's hardly triple.

Deduct the one-in-four ratio (confirmed through 2012) of self-employed licenses that have been canceled or returned due to frustration with state control -- probably an even higher ratio now -- and the net gain (over 15 years) is of 180,000 new licensees.  That's not even double.

But anyone can miscalculate, particularly when relying on a dictatorship's manipulated data.

Most importantly, here's what the Chamber won't tell you about "self-employed" licensees:

- Cuba's "self-employed" licensees have no ownership rights whatsoever - be it to their artistic or "intellectual" outputs, commodity they produce, property, or personal service they offer.

- Licensees have no legal entity (hence business) to transfer, sell or leverage. They don't even own the equipment essential to their self-employment.

As Havana-based lawyer and pro-democracy blogger Miriam Celaya has previously explained:

"The fact that no legal document exists that clearly explains how measures are established for each [self-employment] activity, the particular requirements of each and the obligations and rights of investors, only creates a vagueness and formlessness that favors speculation and corruption on behalf of the regime officials in charge of the process, as well as the defenselessness for those that risk investment in the private sector. To summarize it in a simple phrase: in a State where no citizen rights exist, there are no legal guarantees for slaves that aspire to freedom."

- Licensees have no right to engage in foreign trade, seek or receive foreign investments.

- Effectually, licensees continue to work for the state -- and when the state decides such jobs are no longer needed, licensees are shut down without recourse.

- The only thing licensees have is a "get out of jail free card" (license) that (in theory) doesn't punish them for selling some widgets (like they would in the black-market), though (in practice) the authorities' harassment remains arbitrary and constant.

Moreover, here's what the Chamber won't tell you about foreign investment in Cuba:

- In Cuba, foreign trade and investment is the exclusive domain of the state, i.e. Fidel and Raul Castro. There are no "exceptions."

- In the last five decades, every single "foreign trade" transaction with Cuba has been with a state entity, or individual acting on behalf of the state.

- The state's exclusivity regarding trade and investment was enshrined in Article 18 of Castro's 1976 Constitution.

- Since passage of the 2000 Trade Sanctions Reform and Export Enhancement Act ("TSREEA"), more than $4 billion in U.S. agricultural and medical products have been sold to Cuba. However, all those sales by more than 250 privately-owned U.S. companies were made to only one Cuban buyer -- a company called Alimport, which is the Castro's import monopoly.

- Castro's 2014 Foreign Investment Law offers absolutely not rights to Cubans on the island.  They remain prohibited from transacting business with any foreign entity.  Even more fundamental, they remain prohibited from owning a business, period.

- The 2014 Foreign Investment Law violates six International Labor Organization (ILO) Conventions and the Universal Declaration of Human Rights:

1. Forced Labor Convention (No. 29) and Abolition of Forced Labor Convention (No. 105) - Cuba has used forced and compulsory labor by sending workers to permanent agricultural camps as a means of political coercion and education and punishment for holding expressing opposing political views. In addition, labor mobilizations to work in specific agricultural development projects also violate these Conventions.

2. Freedom of Association and Protection to Organize Convention (No. 87) - Article 1(g) of the new Labor Code grants the workers “the right to associate themselves voluntarily and establish Unions.” In practice, it is not allowed.

3. Protection of Wages Convention (No. 05) - Cuba violates this Convention that prohibits deductions from wages with a view to insuring a direct or indirect payment for obtaining or retaining employment made to a state intermediary agency.

4. Right to Organize and Collective Bargaining Convention (No. 98) - Collective bargaining is nonexistent in Cuba.

5. Discrimination (Employment and Occupation) Convention (No. 111) - By selecting the workers to supply to foreign enterprises, Cuba does not follow the mandate of equality of opportunity or treatment in employment and occupation.

6. Employment Policy Convention (No. 122) - Cuba’s policy is of selecting who works where, regardless of skills or endowments, and transfers are not the result of the will of the worker.

7. The Universal Declaration of Human Rights (Article 23) - Nonexistent in Cuba are: the right to work; free choice of employment; just and favorable working conditions; protection against unemployment; the right to equal pay for equal work; just and favorable remuneration; and the right to form and join trade unions.

Finally, here's what the Chamber won't tell you about Cuba's current political reality:

- Cuba's regime was recently caught red-handed smuggling weapons to North Korea - the largest weapons cache discovered since U.N. Security Council sanctions towards the Kim regime were enacted.

- Cuba's regime has wrested political and operational control of the most resource-rich nation in Latin America, Venezuela; it has undermined that nation's democratic institutions; and led a campaign of repression resulting in the arrest and torture of thousands of innocent student protesters, and the murder of over 40.

- Repression has risen dramatically under Raul Castro; political arrests have at least tripled (reaching nearly 1,000 per month); opposition activists Orlando Zapata Tamayo, Juan Wilfredo Soto and Wilmar Villar have been murdered; and democracy leaders Laura Pollan of The Ladies in White and Oswaldo Paya of the Christian Liberation Movement have died under mysterious circumstances.

- European and Canadian businesses in Cuba have been illegally confiscated, their bank accounts frozen and an unknown number of foreign businessmen imprisoned without charges or trial.

- Democracy activists, including Sonia Garro, an Afro-Cuban member of The Ladies in White, and Angel Yunier Remon, a young Cuban rapper critical of the Castro regime, remain imprisoned after years without charges or trial.

- Raul Castro has taken an American hostage, Alan P. Gross, who was in Cuba helping the island's Jewish community connect to the Internet, in order to extort the United States into releasing five (now three) spies convicted in federal courts of targeting military installations and conspiracy to murder three American citizens and a permanent resident of the U.S.

Welcome to the real Cuba.

Cuba's Ladies in White Reject Council of the America's Proposal

Below is a statement from Berta Soler, leader of The Ladies in White, a democracy group composed of the mothers, wives, daughters, sisters and other relatives of Cuban political prisoners.

The Ladies in White are recipients of the Sakharov Prize for Freedom of Thought.

“If the U.S. government lifted restrictions or softens them, it will give oxygen to the Cuban government to strengthen its repressive machinery against the people of Cuba and human rights activists.

Giving oxygen to the Cuban government would mean that the U.S. is turning its back on the Cuban people. This country is plunged into hunger and need because of a totalitarian government. An improvement of bilateral relations or authorization of trade between the U.S. and Cuba will benefit the Cuban government, not the Cuban people. Self-employed people would not benefit either, because in Cuba there is a state monopoly.

With regard to the embargo, the position of the Ladies in White is that it should be strengthened. No oxygen to the Cuban government, no diplomatic overtures, because this will not benefit the people of Cuba. When there was a socialist bloc and the Soviet Union, rather than evolving we regressed.  What the Cuban government wants is to buy time to stay in power.”

What a Rockefeller Coincidence on Cuba

Last month, CHC Editor Mauricio Claver Carone wrote in The Huffington Post:

"Because trade and investment entails dealing only with the Castro's monopolies -- a reality people would (or should) find unpalatable -- it begets the question: How can these monopolies be weakened and dismantled?

Various approaches can reasonably be debated, but it is undeniable that "doing business" with state monopolies strengthens and enriches them. If that were not the case, then democratic nations wouldn't need antitrust laws. Democracies would simply feed their monopolies more business and allow them to magically weaken and fall apart. Imagine what "might have been" if in the early 20th Century, the United States' approach to Big Oil was to strengthen its then monopoly. Today many Americans think the oil industry exerts a disproportionate influence, but if it hadn't been for the "trust-busting" efforts of the last century, we might well have become the United States of Rockefeller, working at the behest of monopolists.

Cubans have no choice; they work for the monopolies of Cuban government under the Castro brothers. Increasing U.S. trade and investment in those monopolies is nonsensical. It defies logic to believe that doing more business with monopolies weakens them."

Just over a month later, the Council of the Americas, whose Honorary Chairman and main financier is David Rockefeller, would publish an open letter to President Obama lobbying him to bypass Congress in easing trade and financial sanctions towards Cuba.

Rockefeller, and his associate, Peter Johnson, were (of course) featured signatories of the open letter.

What a coincidence!

The Council of the Americas' Derelict Cuba Letter

This morning, the Council of the Americas released an open letter to President Obama lobbying him to bypass Congress in easing travel and financial sanctions towards Cuba.

A few observations regarding this letter:

1. Policy is not made in a vacuum. It's mind-boggling how this letter purposefully ignores major issues in Cuba policy, including the Castro regime's three-fold rise in political arrests during the last couple of years; its illegal weapons smuggling to North Korea; its subversion of democracy in Venezuela; and its taking of an American hostage to extort the U.S.

2. U.S. policy toward Cuba was specifically codified into law by the Congress. Yet, this letter is asking the Obama Administration to ease sanctions toward the Castro dictatorship by circumventing the rule of law.

3. This is a low information letter - full of theories, void of facts. The entire premise of this letter is that it seeks to help so-called "independent entrepreneurs" in Cuba. They use the terms "independent entrepreneurs," "micro-enterprise" and "self-employed" individuals" inter-changeably and loosely. Yet, they don't define them. Who are the "independent entrepreneurs" they are talking about? What qualifies as an "independent entrepreneur"? Is it someone with a "self-employment" license? Licensees have no ownership rights -- property or intellectual. Moreover, they only have a license to perform a service -- there's no legal entity owned by them. The underlying owner is the regime. So who would the financial transactions they propose be with? The regime, which would then "trickle-them-down"? Click here for more on this issue.

4. It ignores a basic historic premise.  History has proven that the Castro regime only eases economic control when forced to, not as a "good-will" measure. That's what happened in the 1990s, when it was forced to create "self-employment licenses" as a result of the collapse of the Soviet Union, but then reverted and pulled the licenses once the Cuban economy stabilized -- courtesy of Chavez's oil in 1998 and the Clinton Administration's easing of sanctions in 1999-2000. This letter is (once again) reacting to Castro's bait.

5. There's an easier, legal and less costly alternative. The Obama Administration doesn't have to circumvent U.S. law to help "independent entrepreneurs" in Cuba. Rather than opening a financial spigot for the Castro regime, simply require all current U.S. travelers to stay at "casa particulares" and "paladares" -- "self-employed licensees" who rent rooms and host diners at their homes -- during their visits to Cuba. Currently, every single U.S. "people-to-people" traveler stays at a Cuban military-owned 4 and 5 star hotel and dines at its restaurants.  Thus, the biggest financial beneficiary of current U.S. travel to Cuba is the Castro regime's tourism conglomerates. Viajará a Cuba la plana mayor de la Cámara de Comercio de EEUU

La Cámara de Comercio de Estados Unidos (USCC), uno de los más poderosos grupos de influencia política de ese país, realizará un viaje de alto nivel este mes a Cuba para explorar las transformaciones económicas emprendidas por Raúl Castro, informó Diario Las Américas.

Dos miembros de la USCC vinculados al llamado Grupo de Trabajo de Cuba dijeron que el viaje se realizará en mayo y que la delegación estará encabezada por Thomas J. Donohue, presidente de la organización y un firme partidario de levantar el embargo estadounidense a la Isla.

"La Cámara de Comercio está preparando este viaje con mucho interés en un momento particularmente interesante en el panorama económico y de inversiones en Cuba", dijo un empresario que pidió no ser identificado. "Creo que es algo que va a tener mucha repercusión en Washington".

La fuente dijo que, además de Donohue, la delegación estaría conformada por dos pesos pesados del mundo empresarial estadounidense: Steve Van Andel, director de la junta directiva del conglomerado Amway y actual vicepresidente de la USCC, y Patricia A. Woertz, presidenta del emporio de productos agrícolas Archer Daniel Midland (ADM).

El momento del viaje de la USCC no puede ser más crucial para la economía cubana de cara una posible ampliación de lazos comerciales con Estados Unidos.

El Gobierno cubano ha puesto en marcha la Zona Especial de Desarrollo del Mariel (ZEDM) y está en vísperas de hacerse efectiva la Ley de la Inversión Extranjera, que entra en vigor en junio.

Según las fuentes citadas por el diario, los visitantes tienen previstas reuniones con el canciller Bruno Rodríguez, el ministro de Comercio Exterior y la Inversión Extranjera, Rodrigo Malmierca, y Orlando Hernández Guillén, presidente de la Cámara de Comercio de Cuba, además de realizar un recorrido por la zona del Mariel.

Será la primera visita de los máximos ejecutivos de la USCC en más de una década. En julio de 1999, durante una estancia de tres días en La Habana, Donohue se entrevistó con ministros cubanos y con el entonces gobernante Fidel Castro.

En esa ocasión, Donohue conversó con representantes del reducido sector de cuentapropistas y pronosticó que quedaba un largo trecho por recorrer para fortalecer la empresa privada en la Isla.

La USCC representa los intereses de más de 300.000 negocios como socios directos, y de unos tres millones de empresas a través de sus afiliados en cámaras estatales y locales. Es el principal bastión de lobby en el Congreso, con un presupuesto anual de 136 millones de dólares.

¿Tienen elementos de la NOMENKLATURA castrista billetes "metidos" en clubes de la Liga Mexicana de Béisbol? Si, como supongo, es una realidad ¿Alcanza solo al beisbol? La última fue que a Alfredo Despaigne (foto inicio) lo sorprendieron jugando con identidad falsa en el circuito mexicano, bajo protección ilegal de un pasaporte dominicano ¿Cómo sucedió con alguien que estaba allí bajo reglamento y condiciones NORMALES de contrato? Debajo, Antonio Castro:

 La encargada de estos asuntos en el país caribeño inmediatamente se desmarcó, quién sabe si por cuestiones de seguridad, e informó que habrá una investigación más amplia. Todo lo anterior lo leí en el sitio web DIARIO DE CUBA.

¿El Departamento de Inmigración-Emigración de México pasó por “bobo” durante más de un año? ¿Habrá algún propietario o partícipe en utilidades de los Piratas de Campeche (FOTO DIRECTIVA con Higinio Vélez) en La Habana? ¿Cuáles son la verdaderas relaciones de este equipo con la dictadura castrista, incluso del Veracruz? Porque "Tony", el hijo playboy del tirano, no esconde su interés por compartir titulares con magnates del Beisbol Organizado (para lo que mal habla ingles) y México es una plaza de esa pelota, porque pertenece al circuito de Ligas Menores.

Sin embargo, que quede claro, directamente el jugador no es el culpable, sino la tiranía, la liga y el Departamento del Tesoro Americano, así como el de Estado, que en su empeño por violar el embargo, hacen lo que sea y esto lo ratifica; de antemano, el pelotero es culpable parcialmente, a fin de cuentas, no tiene autonomía ni es libre ni responsable por sus acciones, que no son suyas.

Evidencia alterna de lo que se puede producir cuando se trata con ese hato de bandidos que usurparon a Cuba, que deciden y manejan todo lo relativo a los contratos de jugadores, cuyo única “vela en este entierro” es montarse en el avión sin saber ni a dónde van, bajarse en el país al que los mandan, ponerse un traje y jugar pelota; si acaso, comprarse una Coca Cola con el estipendio diario, porque, hasta donde sé, ninguno ha comprado un auto dentro ni fuera de Cuba, ni alquilan un apartamento o una casa en el país en el que juegan. Tampoco, supongo, podrán viajar con la esposa y los hijos, como se estila por cualquier deportista profesional del mundo libre y soberano que juegue fuera de su patria.

Se está hablando de un régimen sin decencia ni escrúpulos para cometer actos delictivos de mayor cuantía, incluso actos terroristas y asesinatos por encargo, al que no le importa cómo quede el nombre del colaborador. A pesar de... todavía hay quienes justifican y patrocinan esas indecencias, colocándolos en plano de “infelices agredidos”.

Esta claro que a la Méxicana (foto Plinio Escallante, Pdte del circuito) no pueden volver, porque está clasificada TRIPLE A y pertenece al BEISBOL ORGANIZADO; así, mientras HIGINIO VÉLEZ, descaradamente decía que con MLB no estaban dispuestos a cerrar tratos ni contratos, se metían ¿o los metían Selig y Cía? en ese beisbol, a través de las Ligas Menores.

Les quedan las Ligas del Pacífico (donde no hay tanto cupo), incluyo a Australia, también a Italia, con la disyuntiva de que en Europa no tendrán posibilidades de desarrollo.

Lo interesante será conocer qué dirá Bud Selig, incluso Obama, que, sabiendo, como medio mundo, que el Campeche y la Liga Mexicana pertenecen al beisbol que dirigen, recibían jugadores castristas en franca y abierta violación de las leyes del embargo, a pesar del robo de identidades.

Hsta hoy, nada se conoce de los implicados en el asunto ni de la intención que tuvieron, es decir, la tiranía y Estados Unidos, porque el circuito mexicano es un intermediario, ni de investigaciones que, parece, comenzaron hace rato, con la posibilidad de que contratar para botarlo inmediatamente a Jorge Fuentes (foto con directiva del Campeche) funcionara para desviar la atención del asunto y detener la investigación...

El problema no es si Despaigne jugó o no con un pasaporte coreano o francés, sino, como que en esa Liga no puede jugar ni participar nadie de la Cuba de los “hombres nuevos” ¿Cómo les permitieron colarse, a Despaigne y a los otros, con toda la publicidad de los medios que cubren la pelota americana y la mexicana?

Como quiera que se analice, a los efectos legales de jurisprudencia comercial, la Liga Mexicana es parte de la organización americana del beisbol conocida  como BEISBOL ORGANIZADO, capítulo LIGAS MENORES, aparentemente, concluyó la Aventura castrista para evitar las "deserciones" en un país que le venía como anillo al dedo.

Sin embargo, esperemos por el otro conejo que sacarán MLB y las Administración Obama para continuar ayudando a violar las leyes del embargo a esa caterva de ladrones.

As we have predicted all along -- the Castro regime is never going to sacrifice the hundreds of millions (if not billions) it reaps from current U.S. travel to Cuba.

It also sadly demonstrates -- despite what some in the U.S. government argue -- that the benefits the Castro regime reaps from U.S. travel greatly outweigh any costs it may impose to its rule.

Cuba to Renew Passports of Citizens Living in the USA

The Cuban Interests Section in Washington today announced that it will renew expired passports of Cubans residing in the United States who plan to travel in the coming months to the island, reported dpa news.

The good news from the island’s diplomatic mission comes despite having yet to find a solution to the suspension of consular services because of not having a bank that will handle its accounts.

The Cuban Interests Section issued a statement calling the measure “temporary” that will “create conditions in our Consular Office to renew expired passports or those coming due from those citizens residing in the United States who are booked to travel to Cuba in the period May 15 to August 31, 2014.”

Caribbean Transfers admite que el fraude del Medicare 'terminó contaminando' sus cuentas

Dinero defraudado al seguro de salud norteamericano Medicare "terminó contaminando" las cuentas de Caribbean Transfers, según admitió este lunes la propia compañía.

La empresa insistió en que "los bancos de Miami" eran los que "manejaban las 70 cuentas" de las compañías defraudadoras del Medicare.

Tras descalificar al autor de la investigación publicada en DIARIO DE CUBA, con alusiones personales, el comunicado pide que se pregunte a los bancos "por qué enviaron" el dinero, "que ni queríamos ni necesitábamos y que terminó contaminando las cuentas de Caribbean Transfers".

La empresa, a través de un blog habilitado para defenderse del marasmo judicial en el que se encuentra, niega que el expropietario Jorge Emilio Pérez de Morales Sante sea un "fugitivo" de la justicia estadounidense.

Pérez de Morales Sante está acusado de "conspiración para lavar dinero" y actualmente está en búsqueda y captura por Interpol. Se enfrenta a una pena máxima de 20 años de cárcel.

"La primera mentira es llamarlo fugitivo (...) No se puede escapar de Estados Unidos porque no es de allí, nunca ha vivido allí, y tampoco ha visitado ese país durante el periodo en que se dice ocurrieron los hechos", dijo 

Un documento judicial de Florida, de octubre de 2012, confirma que Pérez de Morales Sante tiene estatus de "fugitivo".

Según Caribbean Transfers, "los medios de Miami manipulan a la audiencia y a los lectores creándoles la impresión de que nuestro ejecutivo fue enviado por las autoridades del gobierno cubano a estafar a los seguros médicos y luego envió a Cuba los dividendos de dicha estafa".

"Todas son mentiras mal intencionadas, preparando el camino hacia una condena segura", especula.

Dice la compañía que el reportaje publicado por DDC este lunes "menciona muchas compañías que operan legalmente en sus países y mucha documentación, pero ninguna indicando que esas empresas son propiedad de Caribbean Transfers".

"¿Cuál es el delito de estas empresas? ¿Ayudar a las familias en Cuba enviándoles medicinas, comida y dinero?", se pregunta.

Caribbean Transfers, según autoridades federales, fue usada para lavar unos 30 millones de dólares estafados al Medicare. La compañía opera actualmente con el nombre de 123envialo y tiene como socio logístico a una empresa del Gobierno cubano.

es un lugar comun en los asuntos cubanos que se exageren los exitos del gobierno cubano en politica internacional y pasen inadvertidos los fracasos algunos de ellos contundentes, como el que refleja el siguiente despacho. cuba advertida reiteradamente que debia encontrar una entidad financiera para continuar tramitando sus cobros y pagos en la oficina de intereses en washington, opto por la solucion dura de acentuar la crisis para presionar a la administracion obama que tiene asuntos mas apremiantes que atender y cerro el consulado a la renovacion de pasaportes y permisos de entrada.  toda vez que la emigracion cubana en el exterior y particularmente en los eeuu, ocupa el 2do lugar en emision de turistas a la isla, el regimen recoge pita y levanta parcialmente la medida. se sabia desde hace unas semanas, que las agencias de viajes a cuba en la florida estaban viajando a washington con el pasaporte de sus clientes para que fueran renovados. no extrana el nivel de informacion interno y tanta solicitud por sus clientes de estas entidades???

La Sección de Intereses de Cuba en Washington anunció hoy que los cubanos residentes en EE.UU. que tengan pasajes para viajar a la isla este verano podrán renovar sus pasaportes si lo necesitan, como solución temporal mientras busca banco con el que operar y restablecer sus servicios.

En un comunicado que dio a conocer la agencia EFE, la misión diplomática de La Habana en Washington informó hoy de que todavía no ha encontrado un banco en Estados Unidos que asuma sus operaciones y, por tanto, ofrecerá esta solución temporal a los cubanos con reservas para viajar a la isla entre el 15 de mayo y el 31 de agosto de este año.

El pasado 14 de febrero, tanto la Sección de Intereses como la misión permanente de Cuba ante la ONU perdieron la capacidad de realizar depósitos en su entidad financiera, el banco M & T, y desde el 1 de marzo se quedaron sin cuenta bancaria en Estados Unidos.

Ese banco decidió el pasado noviembre rescindir los servicios que prestaba a la Sección de Intereses pero, después de que Cuba se viera obligada a suspender durante dos semanas su atención consular, decidió otorgar una prórroga para el cese de sus servicios a ambas misiones diplomáticas, hasta el 1 de marzo.

"A pesar de los esfuerzos realizados, todavía no ha sido posible encontrar un banco radicado en los Estados Unidos que asuma nuestras operaciones bancarias, debido a las regulaciones derivadas del bloqueo económico, comercial y financiero impuesto por los Estados Unidos a Cuba", explicó hoy la Sección de Intereses en una nota.

Los cubanos residentes en Estados Unidos que necesiten renovar su pasaporte para viajar en verano deberán dirigirse a "las agencias de viaje que tienen vínculos de trabajo con la Oficina Consular, directamente en su sede en Washington DC".

"El plazo señalado pudiera extenderse en caso de que la implementación de la solución alternativa tomara más tiempo del que se ha previsto", precisó la misión diplomática.

Asimismo, la Sección de Intereses recordó que las solicitudes motivadas "por razones humanitarias"  continuarán recibiendo un tratamiento expedito y que, de acuerdo con las normas migratorias vigentes en Cuba, los ciudadanos residentes en el exterior deben portar un pasaporte cubano válido para entrar en la isla.

Desde que suspendiera sus servicios consulares, la misión atiende solo casos "de carácter humanitario" y, hasta la nueva medida anunciada hoy, había dejado de efectuar los trámites asociados a la emisión de pasaportes, visas, legalización de documentos y otros servicios similares.

El Gobierno estadounidense ha reiterado en varias ocasiones que desde el pasado verano ha estado asistiendo a Cuba en el asunto y ha contactado "a más de 50 bancos" para encontrar un sustituto a M & T.

Según fuentes cercanas a la misión cubana, la decisión del M & T de suspender sus servicios es algo que decidieron hacer con "varias misiones diplomáticas" y el problema para Cuba ha aparecido a la hora de encontrar otro banco que esté dispuesto a prestarles servicios mientras continúa el embargo financiero a la isla.

Por vender vuelos a Cuba, EE.UU. multó a Despegar.com con US$ 3 millones

La agencia de viajes online Despegar.com acordó con el Tesoro de Estados Unidos una multa de US$ 2.809 millones por haber vendido pasajes de avión hacia Cuba y estancias en hoteles de la isla caribeña.

De acuerdo con el gobierno estadounidense, Decolar.com Inc. se presentó voluntariamente para anunciar que había incurrido en una falta antes de que se dieran cuenta en las agencias de control.

El problema no habría existido de no ser porque Despegar.com se constituyó como sociedad incorporada en el estado de Delaware (bajo el nombre de Decolar.com Inc). La empresa está por tanto sujeta a la legislación estadounidense que restringe los negocios con Cuba y que, según la Oficina de Activos Extranjeros del Tesoro estadounidense, Despegar.com violó desde marzo de 2009 y hasta el mismo mes de 2012.

En una búsqueda hoy, Clarín.com no encontró ningún producto relacionado con Cuba en la página argentina de Despegar.com.

Gracias a la opacidad fiscal y los beneficios impositivos con que el estado de Delaware recompensa a las empresas que lo eligen, casi la mitad de las corporaciones que cotizan en Bolsa de Estados Unidos se constituyen allí. De acuerdo con un informe del diario The New York Times, el estado tiene más sociedades incorporadas que gente. Desde principios del siglo XX, se distinguió por una legislación impositiva y mercantil muy favorable para atraer a las empresas de Nueva York y Nueva Jersey.

Agencia de viajes multada con $5 millones por violar embargo a Cuba

Una importante compañía holandesa que manejó los viajes de 44,430 personas desde y hacia Cuba, le pagará $5.9 millones al gobierno de EEUU para resolver una querella que violó el embargo a la isla, anunció el Departamento del Tesoro de EEUU.
El anuncio del Tesoro dice que CWT B.V. continuó haciendo negocios con Cuba después de convertirse en una empresa de capital mayoritariamente estadounidense, en 2006, y por tanto sujeta al embargo.
La multa parece ser una de las mayores impuestas a una agencia de viajes por violaciones al embargo, aunque varios bancos extranjeros han tenido que pagar cientos de millones de dólares para resolver presuntas violaciones.
CWT B.V. fue parte de Carlson Wagonlit Travel, un líder mundial en viajes con centro de operaciones en Holanda. CWT se especializa en viajes de negocios, opera en más de 150 países y reportó $21,400 millones en volumen total de ventas, en 2009, según sus páginas web.
El Tesoro no identificó a los compradores estadounidenses de CWT, en 2006. One Equity Partners II, L.P., subsidiaria de JPMorgan Chase, y Chase Travel Investment, de JPMorgan, fueron mencionadas en reportes de negocios como propietarios de CWT, en 2010.
Las compañías pertenecientes a estadounidenses que hagan negocios con Cuba o con entidades cubanas requieren una licencia especial expedida por la Oficina de Control de Bienes Extranjeros (OFAC) del Tesoro, que vela por el cumplimiento de las sanciones de EEUU en todos los países extranjeros.
Las posibles violaciones de CWT tuvieron lugar desde el 8 de agosto de 2006 hasta el 28 de noviembre de 2012, aproximadamente, “con negociaciones en las que Cuba o sus nacionales tenían un interés” e involucraron viajes de 44,430 personas, dijo el Tesoro en un comunicado el viernes.
OFAC dijo que la multa base para el caso fue de $11,093,500, pero fue reducida a $5.9 millones porque CWT reportó voluntariamente las supuestas violaciones, las detuvo, cooperó con los investigadores de EEUU y tomó “acción correctiva significativa”.
CWT es una “corporación internacional comercial sofisticada y de servicios de viajes”, dice el comunicado del Tesoro, “pero fracasó en ejercer un grado mínimo de precaución o cuidado relacionados con sus obligaciones de cumplimiento de las sanciones OFAC hacia Cuba”.
El gran número de viajeros hacia Cuba que manejó, “causó un daño significativo a los objetivos” de las sanciones de EEUU contra la isla de gobierno comunista, bajo las Regulaciones de Control de Bienes Cubanos (CACR).
JP Morgan Chase Bank acordó pagar $88.3 millones en 2011 para resolver acusaciones de violaciones “escandalosas” a las CACR, por el procesamiento de 1,771 transacciones bancarias por un total de $178.5 millones, desde el 12 de diciembre de 2005, hasta el 31 de marzo de 2006, involucrando a Cuba o a nacionales cubanos.
JPMC investigó una pista de otra institución que podría estar violando las regulaciones, la confirmó y a pesar de ello “fracasó al no seguir los pasos adecuados para prevenir transferencias futuras”, y no reportó voluntariamente las supuestas violaciones, dijo el Tesoro en ese momento.
El banco ING en Holanda pagó $619 millones en 2011 para resolver acusaciones de comercio ilegal con Cuba, Irán y otros países sancionados. Credit Suisse Bank pagó $536 millones en 2009 y la suiza UBS pagó $100 millones en 2004, por casos similares.

Cuba, you owe us $7 billion

If symbols could gather rust, the American trade embargo against Cuba would be covered with it. Enacted in 1960, shortly after Fidel Castro came to power, and expanded in 1962, at the height of the Cold War, the embargo has frozen the United States and its tiny neighbor off the Florida coast in a standoff that seems as dated as the classic American cars on Havana streets.

Leaders from around the world have been calling on the United States to dismantle the embargo for more than 20 years, and recent polls show that a majority of Americans are in favor of lifting it. With the repressive Castro regime seemingly nearing its end, a “normalization” of relations between the countries seems increasingly within reach. That would appear to spell an end sometime soon for the embargo, which in the popular imagination stands as a sort of political weapon that was designed to cripple Castro and stem the tide of communism.

What’s oftenforgotten, though, is that the embargo was actually triggered by something concrete: an enormous pile of American assets that Castro seized in the process of nationalizing the Cuban economy. Some of these assets were the vacation homes and bank accounts of wealthy individuals. But the lion’s share of the confiscated property—originally valued at $1.8 billion, which at 6 percent simple interest translates to nearly $7 billion today—was sugar factories, mines, oil refineries, and other business operations belonging to American corporations, among them the Coca-Cola Co., Exxon, and the First National Bank of Boston. A 2009 article in the Inter-American Law Review described Castro’s nationalization of US assets as the “largest uncompensated taking of American property by a foreign government in history.” 

Today, the nearly 6,000 property claims filed in the wake of the Cuban revolution almost never come up as a significant sticking point in discussions of a prospective Cuban-American thaw. But they remain active—and more to the point, the federal law that lays out the conditions of a possible reconciliation with Cuba, the 1996 Helms-Burton Act, says they have to be resolved. According to that statute, said Michael Kelly, a professor of international law at Creighton University in Nebraska, settling the certified property claims “is one of the first dominos that has to fall in a whole series of dominos for the embargo to be lifted.”

While the other dominos are clearly much more daunting—the overall point of the Helms-Burton Act is that Cuba has to have a democratic, America-friendly government in place before there can be any talk of lifting the embargo—experts say the property claims will be an intensely difficult problem to settle when it comes time to do so. For one thing, Cuba is unlikely to ever have enough cash on hand to fully compensate the claimants, especially while the embargo is still in place; to make matters even more complicated, many of the individual claimants have died, and some of the companies no longer exist.

With Cuba inching toward reform on a number of fronts over the past several years, giving hope to those who believe our two countries might reconcile in the near future, a number of Cuba experts have begun to study the question of how to resolve the property claims in a way that is both realistic and fair. The proposals that have come out of their efforts provide a unique window onto the potential future of the American relationship with Cuba—and point to the level of imagination that can be required in the present to turn the page on what happened in the past.

The Cuba that Castro took over in 1959 was a nation overrun with American business. Tourists could stay in American-owned Hiltons, shop at Woolworth’s, and withdraw money at American-owned banks. American-owned petroleum refineries sat amid American cattle ranches, sugar factories, and nickel mines, and an American-owned telecommunications firm controlled the country’s phone lines. According to a 2008 report from the US Department of Agriculture, Americans controlled three-quarters of Cuba’s arable land.

Cuba’s revolutionary leader swiftly signed several laws nationalizing what was previously private property. Though the laws required the government to compensate the owners, the payment was to be made in Cuban bonds—an idea that was not taken seriously by the United States. In 1960, the administration of President Eisenhower punished Castro’s expropriation of American assets by sharply cutting the amount of sugar the United States was buying from Cuba. “We kind of went ballistic at the thought that anyone would take our property,” said John Hansen, a faculty associate at Harvard University’s Center for Latin American Studies. Tempers ran hot in both directions: in a speech, Castro vowed to separate Americans in Cuba from all of their possessions, “down to the nails in their shoes.” The standoff culminated in a near-total embargo on American exports to Cuba and a reduction of sugar imports to zero.

Other countries that had holdings in Cuba—including Switzerland, Canada, Spain, and France—were more amenable to Castro’s terms, apparently convinced that there was no chance they’d ever get a better deal. But the Americans who had lost property wanted cash, and submitted official descriptions of what had been taken from them to the Foreign Claims Settlement Commission at the Department of Justice. Meanwhile, US relations with Cuba deteriorated. Diplomatic ties were cut. An attempt by President Kennedy to overthrow Castro failed, and a standoff over Soviet missiles in 1962 brought the world as close to nuclear war as it has ever come. The invisible economic wall—which by then had been expanded to ban virtually all imports from Cuba—had become part of something much larger.

Half a century later, the cash claims that started it all still sit on the books. And while a full list of claimants is maintained by the US Department of Justice, they have largely receded from view—in part because most of the claimants have become quiet about their hopes for compensation. According to Mauricio Tamargo, a lawyer who served as chairman of the Foreign Claims Settlement Commission for almost a decade before going into private practice and taking on a number of claimants as clients, complaining about monetary losses associated with the Cuban revolution has become increasingly risky from a public relations standpoint. The embargo has taken on more and more political meaning, and Cuba has become more destitute. “The corporations that have these claims are very sensitive to bad press,” Tamargo said, “so they decide to keep a low profile and work quietly behind the scenes where possible.” (Of several corporate claimholders contacted for this story, the only one that provided a statement by deadline was Chevron Corp., which now owns the claims originally filed by Texaco, and considers “the claim to be valid and enforceable if and when there is a change in the Cuban government.”)

But regardless of how morally or politically sensitive it might be for America’s corporations and the wealthy executives who run them to claim money from Cuba, their claims will still need to be untangled in order for the embargo to be lifted, experts say. “The US government is obligated by law to defend the claims of US citizens and enterprises whose properties were expropriated by the Cuban government,” wrote Harvard professor Jorge Dominguez, a top Cuba scholar, in an e-mail. As for how that might be done, he added, “one can imagine a range of possibilities.”

One possibility has been put forth by Tamargo, who advocates for an approach that would compensate claimants—his clients among them—by imposing a 10 percent user fee on all remittances sent to Cubans by their American relatives, as well as all other transactions that are allowed to take place under the current embargo rules. (While this proposal can be seen as a tax on US residents, it is designed to come only out of money that is entering the Cuban economy.) Another proposal was presented several years ago by Timothy Ashby, a Miami lawyer, who started a company designed to buy claims at a discount from their original owners and then use them to broker a private settlement with the Cuban government. Ashby’s plan was thwarted when the Bush administration declared it illegal, but the prospect of a negotiated group settlement remains on the table—as long as it’s carried out by the US government, in accordance with existing law.

Perhaps the most ambitious and pragmatic solution that’s been laid out so far appeared in a lengthy report published by scholars at Creighton University, who were given a grant in 2006 by the US Agency for International Development to investigate the claims issue. “There was a hope that, if through God’s grace things improved and we were able to enter into a mutually beneficial relationship with Cuba, we would be able to pull something off the shelf and say, ‘Here’s how we’re going to start dealing with it,’” said Patrick Borchers, the law professor who led the Creighton team.

Borchers and his colleagues found that untangling all the claims would be extremely complicated: “A lot of the original corporate claimants, through the process of 50 years worth of mergers and acquisitions, don’t even exist anymore,” said Creighton’s Michael Kelly, who also worked on the report. “But the claims don’t go away—they go with the mergers.” One of the largest claimants today, for example, is Starwood Resorts, a company that didn’t even exist in 1959, but received a claim on the ITT Telegraph Tower when it acquired another company. “Starwood Resorts doesn’t want an old radio tower,” Kelly said. “What they [might] want is beachfront property.”

This insight led to the proposal that the Creighton team ultimately submitted to the government. Under the team’s plan, some of those who had lost property during Castro’s nationalization campaign could be compensated in ways that didn’t involve the transfer of cash or bonds: Instead, they could be given tax-free zones, development rights, and other incentives to invest in the new Cuba. This, according to Borchers, would be a win for both sides, compensating the claimants while stimulating the Cuban economy.

No one is arguing that settling the property claims of Americans is anything like the first or most important step to normalizing the US relationship with Cuba: There are other, more formidable obstacles in the way, as well as significant wiggle room for increasing economic activity between the two countries without formally lifting the embargo.

“There’s a scenario that I see, which is bit by bit the fundamentals of the embargo are chiseled away by executive order, by the economic and family ties linking Cuba and the United States, and by non-enforcement,” said Julia Sweig, a Cuba expert at the Council on Foreign Relations. In that scenario, the claims might someday be resolved, but wouldn’t hold the process of reintegrating the United States and Cuba hostage.

There’s another big complication, too: the thousands of Cuban families who fled to America after the revolution and had everything they owned confiscated by the Communist regime. These Cuban exiles and their descendants form the backbone of the most intransigent anti-Castro lobby in the United States. If and when Cuba does open up, they’re going to want their property back as well, which will likely result in extensive litigation in Cuba. (To address their interests, the Creighton report proposed setting up a special tribunal in Cuba that could try to compensate Cuban-Americans for their losses once the country had found its feet economically.)

What will end up happening—both for the American claimants and the Cubans who moved here after the revolution—will undoubtedly provoke debate about what is fair when it comes to setting right the wrongs of the past. How much debt is worth forgiving to help a country back on its feet? And how much should private citizens expect to give up to help a diplomatic resolution? But the provisional plans and proposals that have been made in the meantime—whether preferential development deals or a tax on cash flow between our two countries—reflect something else: visions of a new Cuba, in which American economic interests and Cuban ones are once again closely intertwined.

U.S. Chamber of Commerce, other groups prepare Cuba trips

CUBA STANDARD — As the government lets Cubans set up their own micro businesses, launches an export processing zone at Mariel, and passes a new foreign investment law, at least three U.S. trade groups and think tanks, including the powerful U.S. Chamber of Commerce (USCC), are planning trips to Havana this spring.

While U.S. business delegations have been traveling to Cuba for more than a decade, their number and high level is noteworthy.

Geoff Thale, program director of the Washington Office on Latin America (WOLA), a long-time advocacy group against the embargo, said that with evolving attitudes of the Cuban exile community toward Cuba, and interest among U.S. lawmakers to engage with Cuba, he’s not surprised to hear about these upcoming visits.

“I think all the travel we are seeing reflects growing recognition that change is going on in Cuba, and growing momentum for change in U.S. policy,” he said.

The Washington-based USCC, the influential group that bills itself as the voice in Washington of 3 million businesses, is being tight-lipped about their agenda and participants.

“I’m not able to elaborate at this time, said Tyler Hernández, USCC’s manager of media relations. He did confirm that his office is planning an educational trip to Havana this May, but didn’t want to go further. José Raúl Perales, who heads USCC’s Americas Department, was just as cryptic, noting that his office is still organizing the trip.

“There are many moving pieces here, so I don’t have anything about Cuba and the USCC at this time,” he said.

However, talk in Washington circles has it that USCC chief executive Thomas Donohue will be heading the group, which may also include Steve Van Andel, president of the USCC board and chairman of Amway Corp. “I would be hard-pressed to believe that the head of USCC is going to Cuba and will not be meeting with Raúl,” said one insider who declined to go on the record.

The New York-based Americas Society (AS/COA) is also press-shy about an educational trip that its Cuba Working Group is planning to Havana. While not denying that her office is putting together its own educational trip to Cuba, spokesperson Adriana La Rotta refrained from providing details of her office’s agenda, but sources close to the group said AS/COA will use its own license, and that the trip will focus on microcredit and microfinance.

Another group that will send a delegation is the Institute of the Americas. Located on the University of California’s San Diego campus and headed by Charles Shapiro, a former U.S. Ambassador to Venezuela and a former coordinator of Cuban Affairs at the U.S. Department of State, the Institute of the Americas is organizing an educational one-week trip to Cuba this May under an OFAC license. Shapiro is leading that trip, which will let participants talk to high-ranking Cuban government officials, interact with members of the island’s emerging small business owners, meet artists and musicians, and debate with economists about the reforms.

It’s an educational trip to show people what’s happening on the ground in Cuba,” said Chandler Martin, Director of Cuba Programs at the Institute of the Americas. “Charles is going. I’m going, along with a group interested in Cuba policy.” Leaving out who was joining her trip, Martin would only say “the group includes individuals who are either retired or are simply interested in Cuba.”

Martin did say that many participants are interested in the Mariel port expansion and what it means for Cuba’s current investment promotion efforts, along with its export processing zone and who is likely to sign on to it, such as companies from Brazil and China. She also mentioned Cuba’s new foreign investment law as a draw for participants.

News of influential U.S. groups trekking to Havana is well-received by advocacy groups. “I think the visits – by the Chamber, the Americas Society, the Institute (of the Americas) in San Diego—reflect several related trends,” said WOLA’s Thale. “First, the process of economic reform in Cuba has sparked interest in the U.S. business community, (which is) reflected in (events) like the upcoming conference co-sponsored by the International Law Section of the Florida Bar on doing business in Cuba. The just-announced investment law, the emerging small business sector, the port at Mariel, all suggest possibilities for trade and investment, and the business community is interested in exploring now what those possibilities might be down the road.”

“Second, the reform process in general has piqued the interest of a variety of foreign policy analysts who are trying to get a sense of where the process of change in Cuba is headed,” Thale continued. “A couple of years ago, analysts who followed Cuba were debating whether the reform process was real. That debate is over. Serious analysts agree that the Cuban government is leading a real and serious process of economic reform. I think that has stimulated a lot of interest in questions like what model, if any, the Cuban government has in mind, how far the reforms will go, (and) what political implications they will have.”
